Man rejects plea offers in shaken-baby case

LOCKPORT – A Town of Lockport man, charged with seriously injuring his 5-month-old son by violently shaking him Jan. 22, refused two pre-indictment plea offers Wednesday in State Supreme Court.

Deputy District Attorney Holly E. Sloma gave Christopher T. Fuller Jr., 23, of Dysinger Road, a choice of two pleas. He could have admitted to attempted first-degree assault, with Justice Richard C. Kloch Sr. being able to choose a sentence of between 3 1/2 and 15 years in prison. Or, Fuller could have pleaded guilty to reckless assault on a child with a definite seven-year sentence.

With both offers turned down, Sloma said the case will be presented to the March grand jury. “Post-indictment, there will not be either of these plea offers,” Sloma said.

Fuller was originally charged by police with first-degree assault. If indicted and convicted on that, the maximum sentence is 25 years, with a five-year mandatory minimum.

Sloma said the baby boy has been discharged from Women and Children’s Hospital and “is receiving intensive follow-up care.”
