LOCKPORT – A Niagara Falls man, accused of driving while drunk and under the influence of cocaine while his 9-month-old son was in his vehicle, pleaded not guilty to a nine-count indictment Tuesday in Niagara County Court.

Robert E. Maye Jr., 39, of LaSalle Avenue, is charged with felony driving while intoxicated under Leandra’s Law in relation to his Sept. 13 arrest in Porter.

Other charges include five misdemeanor counts of driving under the influence and single counts of first-degree aggravated unlicensed operation, endangering the welfare of a child and failure to stay in a designated lane.

Deputy District Attorney Theodore A. Brenner said Maye’s blood alcohol content was measured at 0.23 percent in a blood test that also came up positive for cocaine. He said police found open containers of alcoholic beverages in plain view in the auto.

Maye, who is free on a $750 bail bond, was sentenced in 1998 to seven to 14 years in prison for two strongarm robberies.
