Burglar on probation admits to stealing credit card

LOCKPORT – A Porter man, who has been on probation since June for a burglary, pleaded guilty Wednesday in State Supreme Court to stealing a woman’s credit card July 26 and making $359.81 worth of purchases.

Brian E. Schmiege, 26, of Balmer Road, admitted to reduced charges of petit larceny and third-degree identity theft, both misdeanors. Assistant District Attorney John P. Granchelli said restitution is owed to First Niagara Bank, which already reimbursed the victim.

Justice Richard C. Kloch Sr. said he’s likely to continue Schmiege on probation while assigning him to a mental health court. Sentencing was scheduled for April 2.

The burglary occurred Oct. 13, 2012, in Lewiston, where Schmiege stole some smoke bombs from a home.
