LOCKPORT – A Niagara Falls man, who told a probation officer in a presentencing report that he had been selling marijuana and acquired an illegal handgun for protection, was sentenced Wednesday to three years in prison and three years of post-release supervision.
“A felon with a firearm is a very serious offense,” Niagara County Judge Matthew J. Murphy III told Anthony Bogan Sr., 55, of LaSalle Avenue.
Bogan had pleaded guilty to a reduced charge of attempted second-degree criminal possession of a weapon as his trial was about to begin Dec. 3. The gun and 27 bags of marijuana were seized in a Feb. 13 raid on Bogan’s home.
Deputy District Attorney Doreen M. Hoffmann said police told her Bogan continued to sell pot while his charges were pending; Bogan called that statement “a bald-faced lie.”
