Call about ‘troubled’ customer leads to DWI and narcotics counts

Erie County sheriff’s deputies arrested a Delevan man early this morning on felony drunken driving and narcotics charges after receiving a call from an Olean Road business in the Town of Sardinia.

Deputies Theresa Nietzel and Jason Bouton responded to a “customer trouble” call about Codey A. Tingue, 28, of Delevan, who had driven away from the scene before deputies arrived. Deputies did not say if the call came from a bar.

Tingue was found a short time later on Savage Road in Sardinia. Deputies said they found him to be intoxicated, noting he also had a previous drunk-driving charge and his driver’s license had been revoked for prior DWI offenses. As a result, he was charged with felony DWI along with felony aggravated unlicensed operation of a motor vehicle. Tingue refused blood-alcohol content testing, deputies said.

After searching him, deputies said they found Tingue had 11 grams of cocaine and 2.7 grams of marijuana, resulting in additional charges of felony fourth-degree criminal possession of a controlled substance and unlawful possession of marijuana, a violation.

After his arrest around 4:30 a.m., Tingue was taken to the Erie County Holding Center, pending his arraignment in Sardinia Town Court.
