A 54-year-old motorist was charged with a felony count of driving while intoxicated after a one-car accident late Tuesday in the Town of Holland, Erie County sheriff’s deputies reported.
Dennis A. Smith, 54, of Holland, was charged with DWI, as well as imprudent speed and operating with open alcoholic beverages, after Deputy Simon Biegasiewicz investigated an accident on North Protection Road, near Route 16, at about 11 p.m., authorities said.
Smith, who suffered non-life-threatening injuries, was treated at Bertrand Chaffee Hospital in Springville, where a blood sample was taken to determine his blood-alcohol content.
The felony charge was the result of Smith having a previous DWI conviction within the past 10 years, deputies said. Smith was released on appearance tickets.
