Jacob Murphy, the 15-year-old Town of Tonawanda boy struck by a car as he rode his bicyclist on Niagara Falls Boulevard late in the afternoon of Aug. 19 remains in critical condition at Women and Children’s Hospital, Town of Tonawanda Police Lt. Nicholas A. Bado said today. Bado said police accident investigators have determined the SUV driver who struck the boy as he was crossing the boulevard near the intersection with Greenhaven Terrance was not drunk nor on drugs or using a cell phone.
But Bado stressed that other evidence is still being evaluated before a final conclusion can be determined whether criminal charges can be filed. The police spokesmen said his department withheld release of the boy’s name and medical condition for a week out of respect for his family. John Moscato, public spokesman for Women and Children’s Hospital said the boy’s parents have asked the hospital not to release information about him.
