Pastor charged with illegal revolver

ALBION – The 70-year-old pastor of a Middleport church, already facing trial on an incest-linked indictment, has also been charged with criminal possession of an unregistered revolver that State Police said was found in his home when he was arrested last fall for allegedly molesting children in three states.

The Rev. Roy Harriger, pastor of Community Fellowship Church in Middleport, was arraigned Monday before Orleans County Court Judge James P. Punch.

However, he cannot be prosecuted on many of the child sex abuse cases because the statute of imitations has run out. He pleaded not guilty to a new six-count indictment charging him with incest, sodomy and source of sexual conduct against a child within the last five years.

. He is now free and facing trial in Albion.

Drive-by shooting victim suffers grazing wound

A 35-year-old Buffalo man who suffered a grazing bullet wound to his hip during a drive-by shooting Wednesday afternoon on the city’s West Side was treated for his injury and discharged from Erie County Medical Center.

The victim was standing at Massachusetts Avenue and 15th Street when he was shot about 2:15 p.m., according to police.

Pedestrian killed in multi-car crash on Niagara Falls Boulevard

An unidentified female pedestrian was killed when she was struck by a car as she was crossing Niagara Falls Boulevard near East Robinson Road at about 9 p.m. Wednesday, according to Amherst police.

She was pronounced dead at the scene.

The northbound lane of Niagara Falls Boulevard was closed from North French Road to East Robinson while police concluded their investigation.

Another defendant pleads guilty in cocaine case

A 58-year-old Buffalo man has become the 27th of the 30 suspects in a local cocaine trafficking ring smashed in July 2008 to plead guilty.

Jerome C. Crosby pleaded guilty Wednesday before U.S. District Judge Richard J. Arcara to a charge of conspiracy to possess with intent to distribute 500 grams or more of cocaine. U.S. Attorney William J. Hochul, Jr. said Crosby faces a prison term of at least 10 years and up life and a $2 million fine when he is sentenced at 12:30 p.m. June 9.

Hochul said Crosby was intercepted on wiretaps a number of times arranging to purchase cocaine.

The summertime 2008 raids that busted up the cocaine ring led to the seizure of 117 firearms, more than five kilograms of powder cocaine and more than 200 grams of crack cocaine, Hochul said.

Three arrested in Jamestown marijuana case

JAMESTOWN – Three Jamestown suspects, a man and two women, were being held Wednesday in the Cattaraugus County Jail on felony charges of criminal possession of marijuana for the seizure Tuesday of a package from Texas allegedly containing more than six pounds of marijuana.

Investigators raided a house at 352 Foote Avenue about 1:20 p.m. Tuesday and seized the package.

Taken into custody during that raid were Kelvin Thomas, 31, Saran Best, 32, and Iesha Strudwick, 22.

Jamestown Police said anonymous tips on local drug activity can be made to the department’s TIP line at 483-8477.

Reckless driving suspect jailed after release from hospital

JAMESTOWN – A 24-year-old Jamestown man was taken into custody Wednesday following his discharge from medical treatment at a Rochester hospital for injuries he suffered in a high-speed chase by Jamestown police when he crashed into another car on Foote Avenue on Jan. 20.

Bryan E. Bobe was being held in the Jamestown City Jail pending court proceedings. He is charged with 15 counts of felony reckless endangerment in the first-degree, aggravated unlicensed operation of a motor vehicle, reckless driving, speeding, failing to yield to an emergency vehicle and nine other vehicle and traffic infractions.

Buffalo man charged in theft from a Lockport home

LOCKPORT – State Police in Lockport charged a Buffalo man on Thursday with allegedly stealing items from a home in Lockport and then selling them for cash in Buffalo.

Steven J. Mouery, 40, of Gallatin Street was charged with fourth-degree grand larceny, a felony. He was arraigned in the Town of Lockport Court before Justice Cheryl Antkowiak and remanded to Niagara County Jail on $1,000 cash or $2,000 bond. A return court date was set for next Thursday.

The theft was reported by a Lockport homeowner on Sunday. The victim told troopers that money, video games, jewelry and a cell phone were stolen. The homeowner suspected that a relative may have been involved who had access to the residence at the time of the theft. The items were valued at $1,000.

Illegal alien sentenced to a year in prison

A woman who posed as someone else while living illegally in the U.S. was sentenced Wednesday by Chief U.S. District Judge William M. Skretny to a year in prison.

Assistant U.S. Attorney Michael DiGiacomo said Elizabeth Reid came here from Canada and when confronted in July by Border Patrol Agents told them her name was Elizabeth Ortiz.

Reid was later convicted of making a false statement.

Arizona man pleads guilty in cross-state drug smuggling ring

A 29-year-old Prescott, Ariz., man admitted Wednesday to U.S. District Judge Richard J. Arcara that he was part of a drug trafficking ring routinely shipping cocaine and marijuana from Arizona to Western New York before his arrest last year. Shane Grafman pleaded guilty to conspiracy to possess with intent to distribute and distributing, five kilograms or more of cocaine and 100 kilograms or more of marijuana. He also pleaded guilty to a money laundering conspiracy count.

U.S. Attorney William J. Hochul, Jr. said Grafman faces a prison term of at least 10 years when he is sentenced June 25.

Between April 2009 and Feb. 1, 2012 Grafman and others routinely brought cocaine and marijuana from Arizona to Buffalo, sometimes in private jets. During the investigation, lawmen seized about $1 million in U.S. currency, $671,385 of which was found in a hidden compartment of a SUV Grafman drove, Hochul said,

Grafman admitted he personally distributed locally more than 200 pounds of cocaine and more than a ton of marijuana.

Hochul said Elijah Chaffino of Tempe, Ariz., is awaiting sentencing on his conviction in the ring and trials are still pending against Jordan Ali of Alden, Jason Nati of Buffalo and Jacquelyn Witman of Buffalo and Atlanta, Ga.

Ashville woman arrested for using false identificaton

JAMESTOWN – A 27-year-old Ashville woman was arrested Thursday by State Police and charged with felony second-degree forgery and criminal impersonation for allegedly having used another person’s name during a traffic stop in the Town of Busti a month ago.

Laci J. Lawson was also ticketed for having an uninspected car and for aggravated unlicensed driving. The State Police learned of the January deception when the person whose name was used last month got a notice from the Busti Town Court imposing a $93 fine. That person quickly contacted State Police and Lawson was tracked down and arrested. She faces further Busti Town Court proceedings in several weeks.

Honduran held for illegal entry into U.S.

A 38-year-old resident of Honduras who allegedly tried to enter the United States illegally Tuesday at the Peace Bridge was arrested by U.S. Customs and Border Protection agents.

A federal spokesman said a fingerprint check identified the man as having a number of prior convictions, including an attempted rape of a minor conviction that led to his deportation several years ago. The spokesman would not release the suspect’s name.

Falls man given probation in attempted theft of copper pipes

LOCKPORT – A man who tried to steal copper pipes from a vacant house on Seventh Street in Niagara Falls last year was sentenced Thursday to five years’ probation and 10 days in the Niagara County work program.

County Judge Sara Sheldon Farkas said a presentencing report told her that Jose C. Rivera, 22, of Michigan Avenue in the Falls was unemployed and desperate when he decided to try to steal some copper and sell it to support his family. Rivera was caught in the act April 6 and arrested when he became snagged on a fence he was trying to climb.

Police reported finding 150 feet of freshly cut copper pipes in the basement of the house. However, no restitution was ordered because the property owner never supplied a loss estimate, Assistant District Attorney Laura T. Bittner said.

Farkas said Rivera now is working as a roofer. A co-defendant, Albert A. Torres-Roman, 19, also of Michigan Avenue, is awaiting sentencing on the same charge as Rivera: attempted third-degree burglary.

Man who escaped from courthouse sentenced to 4 to 8 years

LOCKPORT – A man who fled from the Niagara County Courthouse June 27, causing injuries to two officers who recaptured him, attributed his actions to drug use Thursday, as he was sentenced to a total of four to eight years in state prison on three separate felonies.

“The drugs I was using messed up my life,” said Tarale T. Haugabook, 21, of Welch Avenue, Niagara Falls.

Defense attorney James J. Faso Jr. said Haugabook had hoped for some kind of drug treatment as part of the sentence, but State Supreme Court Justice Richard C. Kloch Sr. said he couldn’t do that. Faso said Haugabook had used heroin, cocaine and marijuana before coming to court on the day of the escape.

Despite handcuffs, he ran from the building after Kloch ordered him jailed following his guilty pleas to third-degree burglary for a Feb. 1 break-in in Niagara Falls, and a probation violation on a 2011 conviction for attempted second-degree robbery. He pleaded guilty to attempted second-degree assault in the escape case.

LOCKPORT – Two persons who had pleaded guilty to misdemeanors in separate cases after originally being charged with felonies were each sentenced to three years’ probation Thursday by Niagara County Judge Matthew J. Murphy III.

Colleen D. Vinson, 45, of Ewings Road, Newfane, had pleaded guilty to misdemeanor driving while intoxicated after her fourth alcohol-related driving arrest in the past decade, which came after her vehicle struck a tree on South Main Street in Newfane about 10 p.m. May 17.

Anthony J. Pettitt, 21, of Fourth Street, Niagara Falls, was placed on probation for seventh-degree criminal possession of a controlled substance. He was arrested after a Nov. 26, 2012, police raid on his home at the time, on 24th Street in the Falls. Police said he had 1.55 grams of cocaine and some oxymorphone.

MEDINA – Cocaine, heroin, guns, pills, and a drug known as bath salts were found and three persons were arrested after raids at two Church Street addresses in Medina on Wednesday. In addition thousands of pirated videos and counterfeit merchandise were seized at the Biz Nest, a clothing store on Main Street in Albion, after a year long investigation into sales and distribution of crack cocaine and marijuana conducted by a number of agencies and led by the Orleans County Drug Task Force.

Brenton O. Poole, 28, and Erika H. Poole, 34, both the same address on Church St. were each charged with four counts of third-degree criminal possession of a controlled substance and second-degree criminal possession of marijuana. The Pooles own the Biz Nest.

Norman H. Bloom, Jr., 26, of a different address on Church Street. was charged with second-degree reckless endangerment, second-degree obstruction of governmental administration and resisting arrest.

All three were arraigned in Town of Albion Court, and the investigation is continuing.

As a result of the search at the Biz Nest, police seized more than over 1,000 pirated DVD movies which were being sold, as well as counterfeit clothing and merchandise.

Police release sketch of woman in fatal accident

Buffalo police have released a sketch of an unidentified female pedestrian who was struck and killed by a vehicle just after midnight Thursday at Bailey and Kerns avenues.

Police are still attempting to get a positive identification of the victim, who was pinned under the vehicle. She was pronounced dead at the scene.

No charges have been filed, and the male driver is cooperating with police.

Two men are charged after driving into garbage truck in a stolen car

PENDLETON – A man driving a stolen car rear-ended a Modern Disposal garbage truck Thursday afternoon on Lockport Road in the Town of Pendleton.

Police said Dakota Hewitt, 19, of Lockport, was arrested for driving while ability impaired by drugs and alcohol, following too closely and driving without a license. He also was charged with criminal possession of stolen property in the fourth degree, a felony. Hewitt was remanded to Niagara County Jail on $750 bail.

His passenger, Donathan Alston, 42, of Lockport, was charged with criminal possession of stolen property in the fourth degree and was remanded to Niagara County Jail on $100 bail.

The car had been reported stolen earlier in the day in the City of Lockport. No injuries were reported in the crash.

The crash happened after 12:30 p.m. in an eastbound lane on Lockport Road at the intersection of Campbell Boulevard as the garbage truck was stopped for a red light. The driver of the garbage truck was not injured or charged in the crash.,

A number of police patrol cars were called to the scene when it was discovered that the vehicle, a 2004 Chevrolet Cavalier, had been reported stolen from Webb Street in Lockport at 7:45 a.m.

Lockport Police also are investigating after several items found in the car were believed to have been stolen in Lockport. Further charges may be pending, according to the Niagara County Sheriff Department.

Buffalo juvenile charged with felony robbery

A 15-year-old Andover Avenue boy was arrested on felony robbery and harassment charges about 11:10 a.m. Thursday, shortly after he allegedly robbed another juvenile of an undisclosed amount of cash at Bailey Avenue and Andover Avenue.

The suspect was arrested minutes later at Bailey Avenue and Hastings Avenue and identified by the victim. The suspect allegedly threatened to use a handgun against his victim, but none was actually displayed, according to the victim.

Richmond avenue man charged with selling untaxed cigarettes

A 52-year-old Richmond Avenue man was charged with the tax law offense of offering for sale unstamped cigarettes after he was seen allegedly peddling them about 1 p.m. Thursday in the Main and Court Street area.

James Pittman is accused of approaching pedestrians and selling Indian Nation unstamped cigarettes for $5 a pack. He allegedly still had more than a dozen packs when arrested.

LOCKPORT – A 40-year-old Buffalo man was arrested by the State Police Thursday and held in the Niagara County Jail for allegedly burglarizing a Lockport house of money and personal property on Sunday.

Steven J. Mouery was charged with fourth-degree grand larceny and remanded to the jail in lieu of $1,000 cash bail following his arraignment before Lockport Town Justice Cheryl Antkowiak. Mouery faces additional Lockport Town Court proceedings next week.
