New York City woman arrested in shoplifting case

A 21-year-old local college student from New York City was arrested for shoplifting at the Tops Supermarket at 2101 Elmwood Avenue about 12:15 p.m. Tuesday and then arrested again on a criminal trespass charge when she walked back into the store moments later after being told she was no longer allowed there.

Yazmeen Williams, who gave her home address as 2nd Street, New York City, was charged with petit larceny and criminal trespass. The local college she attends was not disclosed.

Three arrested and large amount of marijuana seized

Buffalo Police enlisted the help of their K-9 corps and arrested three men, seized a large amount of marijuana, cash, and drug paraphernalia including packaging material about 8 p.m. Monday in a house in the first block of Reed Street.

After tracking footprints in the snow and searching the house, they found more than two pounds of marijuana and seized $2,491 in cash.

Arrested on charges of felony criminal possession of marijuana were Joseph Jackson, 28, of East Delavan Avenue; Curtis Hall Jr., 27, of Dorris Avenue and Desmond Lowe, 33, of Grape Street.

Buffalo lawyer spared more jail time for tax conviction

Lisa M. Yaeger, 50, a politically-active Buffalo private lawyer, was spared additional jail time on her misdemeanor conviction for submitting false documents to the Internal Revenue Service and underpaying her federal taxes for the years 2005, 2006 and 2007.

U.S. District Judge Richard J. Arcara sentenced her to time-served and imposed six months of supervised release after the U.S. Attorney’s office informed him she has made full restitution on her tax debt of more than $22,000.

Prosecutor Gretchen L. Wylegala said Yaeger through the years held various local government positions as well are operating a private legal practice. Technically in custody for several hours late last year, she pleaded guilty to the charge Sept. 20 and admitted failing to report substantial income from her private practice for the three affected years. Her misdemeanor plea is not expected to affect her professional standing as an attorney allowed to practice in this state.

Two Buffalo men face North Tonawanda drug charges

LOCKPORT – Two Buffalo men appeared Thursday in State Supreme Court to answer drug charges filed after separate arrests last year in North Tonawanda.

Daniel R. Hill, 34, of Texas Avenue, pleaded guilty to a reduced charge of attempted fifth-degree criminal possession of a controlled substance for having 700 milligrams of cocaine Oct. 21 when police checked on a car in which he was a passenger.

Justice Richard C. Kloch Sr. committed to giving Hill a two-year prison term, concurrent with the time he owes as a parole violator. Sentencing was set for April 2.

In the other case, David A. Lee, 23, of Langfield Drive, pleaded not guilty to third-degree sale and possession of a controlled substance. He is accused of making a drug deal with a police informant June 10.

Man who robbed grandmother at knifepoint pleads guilty

LOCKPORT – A Niagara Falls man pleaded guilty Tuesday in Niagara County Court to robbing his grandmother at knifepoint June 15.

Christopher L. Ford, 32, of 19th Street, admitted to a reduced charge of attempted first-degree robbery and could be sent to prison for as long as 15 years by County Judge Sara Sheldon Farkas April 21.

Falls police called Ford mentally impaired when they charged him June 17 with using obscenities in a courtroom and threatening the judge and police. Tuesday, Ford said he dropped out of school in 10th grade.

Two arrested for break-in at Janet Street house

A 30-year-old Lafayette Avenue man and a 23-year-old Minnesota Avenue woman were arrested on burglary and other charges after allegedly smashing their way into the hallway of a Janet Street house about 12:30 a.m. Tuesday.

The woman occupant told police Ray Williams and Marcellia Braggs tried to force their way through an inside door and threatened her with what appeared to be a silver knife. Both suspects were charged with second-degree burglary, criminal possession of a weapon, criminal mischief, harassment and menacing.

Lewiston couple injured in crash on Route 31

LEWISTON – A man and his wife are both in stable condition in Erie County Medical Center after their car was involved in a head-on crash with a pickup truck at about 10:30 a.m. today on Saunders Settlement Road/Route 31 at Garlow Road. The driver of the pickup was not injured.

State police said the driver of the pickup, Robert Doll, 69, of Lewiston was eastbound on Route 31 when he turned north on Garlow Road and into the path of the oncoming sedan heading west on Route 31 being driven by Robert Triechler, 82, of Sanborn. Nancy Triechler, 78, a passenger in the car, was found unresponsive and not breathing when state troopers arrived.

A trooper was able to remove Mrs. Triechler from the car and establish an airway until emergency medical technicians arrived.

She was taken by Mercy Flight to ECMC with multiple injuries. Her husband was taken by ambulance to ECMC.

Doll was cited for failing to yield.

The Lewiston Fire Department, Town of Lewiston, Town of Niagara Police Departments and the Niagara County Sheriff’s Office responded.

Route 31 from Miller to Kline Road was closed for about two hours due to the crash.

Aggravated DWI arrest made on Grand Island

A complaint about a reckless driver on Grand Island led to the arrest of a 65-year-old town resident, according to Erie County sheriff’s deputies.

The report about someone driving recklessly on Whitehaven Road came in shortly before 8 p.m. Tuesday, deputies said. When the vehicle was pulled over, deputies found that Claudia Preve was intoxicated; a breath test indicated a blood-alcohol content of .19.

Preve was charged with aggravated driving while intoxicated, because her BAC reading exceeded .18 percent, deputies said. She was released on tickets to appear in Grand Island Town Court.




Monkey business leads to arrest of Java couple

WARSAW – A Wyoming County couple face several charges following the seizure of a young Grivet monkey, parts of a deceased red tail hawk and 11 small marijuana plants from their Town of Java residence.

Dara L. Jennings, 56, and Mark D. Galioto, 47, were both arrested Tuesday by state troopers in Warsaw and state Department of Environmental Conservation police, following a lengthy investigation into the illegal possession of the monkey.

Back in August, Wyoming County Probation Officers conducted a home visit, which led to the knowledge of the monkey, which was then seized by the DEC. The investigation into how the couple came to possess the animal continued.

The DEC later determined that the federal acquisition form that Jennings and Galioto used to purchase the monkey had been fraudulently altered. Both Jennings and Galioto were charged with offering a false instrument for filing and tampering with physical evidence, both Class E felonies.

Additionally, Galioto was charged with unlawfully growing cannabis, a misdemeanor. DEC officers also charged both Jennings and Galioto with illegally possessing a Grivet monkey, while Galioto was charged with illegal possession of a red tail hawk. Both are offenses under state Conservation Law.

The pair were arraigned and issued appearance tickets for a later date in Town of Java Court.

Jamestown woman dies in apartment fire

JAMESTOWN – A 25-year-old woman died Wednesday after an unattended cooking fire engulfed the kitchen of a four unit apartment building at 105 Stowe Street in heavy smoke.

Jamestown firefighters, summoned about 7 a.m., removed the victim from the building but she did not survive.

City police said they plan to release the victim’s name this morning, after all of her relatives have been notified.

Student charged in Niagara County bomb threats

NIAGARA FALLS – A 15-year-old Niagara Falls boy who is a student at Niagara Falls High School was charged with falsely reporting an incident Wednesday for allegedly making bomb threats to Niagara Falls and Niagara Wheatfield high schools Monday.

The teen, whose name was not released due to his age, told investigators from the Niagara Falls Police Department and Niagara County Sheriff ‘s Office that it was “a prank gone bad.”

The “prank” caused school officials to lock down Niagara Falls High School and evacuate Niagara Wheatfield High School and Middle School while bomb-sniffing dogs searched the schools.

Police said someone called 911 at 7:55 a.m. Monday claiming bombs were in both schools.

Investigators learned that the call was made from a prepaid mobile phone that had been purchased by a home health aide who had left the phone in the home of a client. The client said the juvenile took the phone without permission and made the calls.

The teen said he had no anger toward either school. He explained to police that he called the two schools because he attended Niagara Falls High and his girlfriend attends Niagara Wheatfield High School.

Investigators said the girlfriend is not believed to be involved.

The charge of falsely reporting an incident is a Class D felony, and the teen will be arraigned in Family Court due to his age, said Niagara Falls Police Detective Lt. Michael Trane.

Closed restaurant damaged in a copper theft

WHEATFIELD – The owner of the former Dad’s Restaurant at 2259 Niagara Falls Boulevard reported to Niagara County sheriff’s deputies that several feet of copper pipe were removed from the building. He said the value of the stolen pipe is about $750, but the damage to the building was about $3,000.

The victim told deputies on Monday that the theft happened sometime since July. He said he believes the suspect may be a family member with a drug addiction who had access to the building.

Wheatfield man faces drunken driving charges following a crash into a snow bank

WHEATFIELD – Niagara County sheriff’s deputies found skid marks, a damaged mail box and a Dodge Avenger off the road in a snow bank at 4:45 a.m. Monday at 6941 Walmore Road. The driver was allegedly driving drunk, said deputies.

Christopher J. Willows, 20, of Jennifer Court, was charged with DWI, failure to keep right, and no seatbelt.

Deputies found the car running and Willows outside, standing behind the car.

Willows said he was going home after visiting a friend and lost control of his car at a bend on Walmore Road. He said he got out of his car to wait for a tow truck.

Employee is suspected of stealing cash and products from a Wheatfield vapors shop

WHEATFIELD – The owner of Exotic Vapors at 2314 Niagara Falls Boulevard contacted the Niagara County Sheriff Department after she suspected a store clerk had been helping himself to cash from the register and products from the store. A total of $1,000 in cash and merchandise was reportedly stolen.

She told deputies Tuesday that the thefts continued until she fired the employee on Sunday.

Owner Lisa Talarico-Jaskula said she noticed a large amount of merchandise was missing when she conducted a store inventory on Jan. 25. She said she began watching the store security footage and found a clerk was making sales to customers and then clearing the register and taking the cash. He was also taking products from the store, she told deputies.

The case was turned over to the Niagara County Sheriff Department Criminal Investigation Bureau.

No arrest was reported.

Driver charged with DWI and 13 infractions

WARSAW – A 26-year-old Franklinville man was arrested for drunken driving in the Town of Arcade early Sunday, the Wyoming County Sheriff’s Office reported Wednesday.

Corey M. Kanner was arrested on Hiram Road by Deputy Aaron Chase about 1:10 a.m after he was observed driving erratically on the road and failing to keep right. Kanner tried to drive off after being pulled over but was stopped on Engle Street in the Town of Freedom after his vehicle struck a drainage ditch. After being treated at Bertrand Chaffee Hospital for minor injuries Kanner was charged with driving while intoxicated and 13 vehicle and traffic infractions.

Yorkshire man jailed after arrest for hammer threat

LITTLE VALLEY – The arrest and jailing of a 36-year-old Town of Yorkshire man was reported Wednesday by State Police. David L. Dietrich Jr. was taken into custody after allegedly threatening his estranged wife with a hammer in her Weaver road home in Yorkshire. After his arraignment on a second-degree menacing charge in Yorkshire Town Court, Dietrich was remanded to the Cattaraugus County Jail pending further proceedings.

Yorkshire snowmobiler charged in crash

LITTLE VALLEY – The arrest of a 24-year-old Town of Yorkshire man for drunken driving on a snowmobile that crashed in a field off Route 16 in the Town of Machias on Jan. 23, suffering injuries, was announced Wednesday. Brandon Lancaster, who was injured in the crash, also was charged with having an unregistered and uninsured snowmobile. He faces further proceedings in Machias Town Court in about two weeks.

Four arrested in stolen check case

LITTLE VALLEY – The arrest of three men and a woman on stolen check charges following a three-week investigation was announced Wednesday by State Police. The investigation began when a woman living in Freedom reported that several of her checks had been stolen and cashed recently in Franklinville.

Arrested were:

• Matthew G. Ballaus, 21, of Franklinville who is being held at the Cattaraugus County Jail on charges of second-degree forgery and criminal possession of a forged instrument in the second-degree.

• Stephen H. Frank IV, 21, also of Franklinville, who is being held on charges of petit larceny, second-degree forgery and criminal possession of a forged instrument in the second-degree.

• Matthew L. Grimes Jr., 20, of Salamanca, who was released without bail after he was arraigned in Machias Town Court on charges of second-degree forgery and criminal possession of a forged instrument in the second degree.

• Katherine M. Loomis, 25, of Franklinville, who posted bailed after her Franklinville Town Court arraignment on charges of second-degree forgery and criminal possession of a forged instrument in the second degree.

Buffalo man pleads guilty in gun-menacing case

A high-speed police chase that ended when the defendant in a gun-menacing case said he ran out of gas resulted in a guilty plea Tuesday.

Andre Smith, 28, of Buffalo, pleaded guilty to second-degree weapon possession.

The chase began April 13 when Buffalo Police Officer Adam O’Shei tried to pull over Smith’s vehicle after a woman said Smith had menaced her with a handgun, according to Erie County District Attorney Frank A. Sedita III. Smith sped away, leading police on a chase through the city that reached speeds of more than 100 mph.

The chase ended when Smith tried to elude police by driving off the road between two houses on Glenwood Avenue and crashed into a garden. He leapt out of the damaged vehicle and fled on foot, with a loaded .45 semi-automatic pistol. Officer John Messina tackled him as he emerged from a backyard.

Police said Smith told officers, “I am a great driver, and I would have gotten away if I hadn’t run out of gas.”

Smith faces 3½ to 15 years in prison when he is sentenced March 26 by State Supreme Court Justice Penny M. Wolfgang.

Orchard Park couple sentenced for evading $1.2 million in taxes

An Orchard Park man was sentenced Wednesday by Chief U.S. District Judge William M. Skretny to a year in prison for tax evasion amounting to more than $1.2 million

His wife, who was convicted of aiding in the preparation of false tax returns, received three years probation.

Vincent and Mary Giamo also were ordered to pay $671.840 in restitution and already have paid $550,000 to the Internal Revenue Service.

Assistant U.S. Attorney Michael DiGiacomo said the Giamos operated a bar known as “Utopia” at 228 Franklin St. and between 2002 and 2005 maintained two sets of books.

The sentencings are the result of an investigation by the Internal Revenue Service.
