LOCKPORT – State Supreme Court Justice Richard C. Kloch Sr. imposed the maximum sentence of seven years in prison and three years’ post-release supervision Tuesday for a Niagara Falls man who sprayed gunfire down a residential block three years ago.
“I’m going to do what I should have done when you were involved with shots fired on the 700 block of 20th Street,” Kloch told Dwayne W. Handley, 31, of Pine Avenue.
Handley pleaded guilty to a reduced charge of attempted second-degree criminal possession of a weapon in January 2012 and was placed on probation. He admitted last November that he violated the terms. Allegations included not reporting to a probation officer, failing to get a job, failing to complete a drug evaluation and failure to pay child support. Handley, who said he has fathered seven children, is $73,000 in arrears.
He was charged with firing three or four shots at a fleeing man. One bullet went through the wall of a house and shattered a picture above the head of a woman who was watching television in her living room, police said at the time of the April 18, 2011, incident.
