Burglar who failed in diversion program is sent to prison

LOCKPORT – Niagara County Judge Matthew J. Murphy III imposed a prison term of 16 months to four years Tuesday for a burglar whose enrollment in a court-supervised drug treatment program ended with a relapse in January.

Murphy said that was the second violation of the rules of the judicial diversion program of court-supervised drug treatment by Brian R. Lederhouse, 28, of Walnut Street, Lockport. He had pleaded guilty in January 2012 to third-degree burglary for break-ins in the summer of 2011 at an apartment and a restaurant in Newfane.

However, there was a diversion success story Tuesday, as County Judge Sara Sheldon Farkas dismissed all charges against Jeffrey J. Thomas, 29, of Linwood Avenue, Niagara Falls. He had pleaded guilty in October 2012 to fifth-degree criminal possession of a controlled substance after being charged with selling Xanax in the Falls in March and April of that year.
