LOCKPORT – A man who tried to steal $1,642 worth of merchandise from the Lockport Walmart store Nov. 16 pleaded guilty Thursday in Niagara County Court and was assigned to the judicial diversion program of court-supervised drug treatment by County Judge Matthew J. Murphy III.

Todd A. Biro, 47, of Portland Street, Town of Niagara, faces up to four years in prison for fourth-degree grand larceny if he washes out of diversion. But if he succeeds, the charge will be reduced to a misdemeanor with a probation sentence.

Biro said he stuffed the stolen merchandise into a suitcase and tried to escape through the emergency exit. Murphy called the scheme “pretty bold.”

“I’m tired of living the way I’ve been living,” said Biro, whose criminal resume includes a felony attempted burglary conviction in 2008.
