LOCKPORT – A Town of Lockport woman who was convicted of robbing the Cornerstone Community Credit Union on South Transit Road, where she was a regular customer, was sentenced to three to six years in prison Monday by Niagara County Judge Sara Sheldon Farkas.
Dale L. Swain, 56, of Robinson Road, had rejected a plea deal in October that would have limited her prison time to four years. A jury found her guilty Dec. 13 of third-degree robbery and third-degree grand larceny in the theft of $4,650 by means of three holdup notes. The money was not recovered; Swain was ordered to repay it after her release from prison.
Assistant Public Defender Christopher A. Privateer said Swain, who served two years in prison for a 2007 Erie County bank robbery, will appeal because she maintains she wasn’t the robber despite identification by credit union workers.
In regard to that claim, Farkas mentioned that Swain’s “significant other” pleaded guilty to perjury for his testimony at Swain’s trial. Lockport City Judge William J. Watson is to sentence Johnny Stratford, 72, of Robinson Road, for third-degree perjury April 9.
