Suit by contractor who worked on Lewiston Road thrown out

NIAGARA FALLS – A judge has dismissed a contractor’s defamation and breach of contract lawsuit against the City of Niagara Falls involving work done on the reconstruction project of Lewiston Road.

State Supreme Court Justice Frank Caruso has thrown out a September 2012 lawsuit by Man O’Trees and owner David Pfeiffer, which, in addition to the city, was filed against the mayor, city administrator, city engineer and every member of the City Council.

It had sought $14 million for breach of contract, $100 million in punitive damages for alleged fraud, as well as other amounts ranging from $50 million to $89 million for alleged defamation and other complaints.

The dispute followed work to rebuild and repave Lewiston Road, a project that was delayed after more radioactive materials than expected were found during the job.

Man O’Trees had done some of the work on the project, but was replaced with another contractor.

Work on the project began in April 2009 and wrapped up last August.
