A Springville man whose driver’s license was revoked after two previous convictions for driving while intoxicated in 2011 and 2012 was arrested early today on a felony DWI charge on Route 219 in the Town of Concord.
Hugh D. Smith, 41, was arrested after Erie County Sheriff’s Deputy Don Hoelscher noticed a vehicle turn from Route 39 in Springville onto the northbound 219 at a high rate of speed and drive from one shoulder of the road to the other. A breath test showed Smith had a blood alcohol level of 0.20 percent, more than twice the legal limit of 0.08 percent.
Smith also was charged with felony aggravated unlicensed operation of a motor vehicle, operating a vehicle without an interlock device, making an unsafe turn and failure to stay in lane.
He was taken to the Erie County Holding Center to await arraignment in Concord Town Court.
