LOCKPORT – Adaberto Olivieri-Perez, who escaped from a U.S. marshal Tuesday after he was arrested on a warrant for failure to appear in court, turned himself in Thursday.
His attorney, James J. Faso Jr. of Niagara Falls, said he met up with Olivieri-Perez in Niagara Falls and drove him to Niagara County Courthouse in Lockport, where Perez pleaded not guilty to a five-count drug indictment.
After court officials flashed the word that Olivieri-Perez was in the building, Sheriff James R. Voutour, Undersheriff Michael J. Filicetti and three deputies arrived to take him to jail after the arraignment.
State Supreme Court Justice Richard C. Kloch Sr. set bail at $25,000, despite a prosecution request for bail to be denied.
“I’m not going to go crazy,” Kloch said.
Olivieri-Perez was originally scheduled for arraignment Dec. 16, but he didn’t show up. Kloch gave Faso a chance to bring him in Jan. 9, but again the defendant didn’t come in, and Kloch issued a bench warrant.
Faso said his client had moved without telling him. Thursday, Olivieri-Perez, 23, said he lives on Willow Avenue in the Falls.
Assistant District Attorney Peter M. Wydysh said after Olivieri-Perez was picked up by the marshal and placed in the back seat of a police car, the defendant maneuvered the handcuffs from behind him to in front of him, got the window down, reached outside and let himself out of the vehicle.
Olivieri-Perez said in court that the car window was already open when he was placed in the auto.
“When ‘The Man’ comes, you go with him,” Kloch told Olivieri-Perez, “You don’t climb out a window.”
“I was scared,” the defendant answered.
“You shouldn’t be scared when you’re with the police. You should be concerned,” the judge replied.
“I was sick,” Olivieri-Perez said.
The indictment stems from a June 19 police raid on the Hyde Park Boulevard apartment in which Olivieri-Perez then lived.
According to police, they seized 0.17 ounces of heroin, 0.129 ounces of cocaine and a small amount of marijuana.
The defendant pleaded not guilty to two counts each of third- and fourth-degree criminal possession of a controlled substance and one count of unlawful possession of marijuana.
Wydysh said more charges are to be presented to a grand jury. Olivieri-Perez was arrested on more drug charges in late July in the Falls, and testimony about Tuesday’s escape also will be presented.
The July arrest involved charges that Olivieri-Perez was selling heroin, marijuana and various pills, 119 of which were seized.
Wydysh said Olivieri-Perez had a long criminal record in Philadelphia, where he formerly lived. That included an aggravated-assault conviction on a docket that originally included another escape count.
