LOCKPORT – A Royalton man pleaded guilty to felony driving while intoxicated Thursday in Niagara County Court, and Judge Sara Sheldon Farkas told him his likely sentence, to be imposed April 4, is one to three years in state prison.
Brian R. Rice, 38, of Rochester Road, has been there before. He served 19 months after violating probation in 2008 for a DWI conviction three years earlier in Steuben County.
In the current case, Rice’s blood alcohol content was measured at 0.20 percent in a blood sample June 20 at Erie County Medical Center, after his auto ran off Rochester Road shortly before 2 a.m. and struck a utility pole. Sheriff’s deputies said he was found behind the wheel, unconscious and bleeding from the head, with the car’s engine still running.
