MAYVILLE – A Portland man who pleaded guilty to criminally negligent homicide in an accident that killed his passenger was sentenced to one and a third to four years in prison Monday and Chautauqua County Court.

Jeremiah Burgess, 23, was given the maximum sentence by County Judge John Ward in connection with the November 2012 accident in Silver Creek that took the life of Jeremy Long, 22.

“The maximum sentence was imposed in this case,” said District Attorney David Foley. The incident avoided a trial for Burgess who was allegedly good friends with the victim.

Long died from injuries following the accident. Burgess, who allegedly fled the scene on foot and turned himself in the next day, also pleaded guilty to leaving the scene of an accident.

The vehicle had reportedly struck some concrete on the side of the roadway near the Routes 5 & 20 split in Silver Creek.
