Marilla night court not meeting because it lacks prosecutor

The Town of Marilla usually holds night court each Tuesday, but it hasn’t yet convened this year.

The Town Board failed to hire a prosecutor at its Jan. 2 organizational meeting. Since then, the night court sessions have been cancelled by Town Justice Thomas Labin.

Approximately 20 court cases have been postponed until Jan. 21, according to Court Clerk Dawn Stover.

If the Town Board has not yet appointed a prosecutor by that date, Labin said he will cancel the night court sessions for the remainder of the month and proceed on a weekly basis until a prosecutor is named.

Two potential appointees were discussed at the organizational meeting: Jennifer Strong, who has served previously, and Rosemary Bapst, an Elma attorney.

Although Town Supervisor Earl Gingerich Jr. asked the Board to pick one of the two applicants, the other council members said they would prefer to interview the two applicants before making a decision.

The next board meeting is Jan. 16.
