One man exonerated and another convicted in burglaries

One man was exonerated and another convicted in connection with a pair of burglaries in North Buffalo last November, according to Erie County District Attorney Frank A. Sedita III.

Donald Clark, 49, a man with three prior felony burglary convictions, was convicted by a jury last week, as charged, of two burglary counts and a single count of criminal possessing stolen property.

Clark stole a pickup truck and drove it to Lovering Street in North Buffalo where he then broke into the garages of two separate homeowners, stealing property inside, Sedita reported.

If found to be a persistent felony offender, Clark faces 25 years to life in prison when he’s sentenced by Justice Russell P. Buscaglia on Oct. 15.

The innocent man, Christopher Fonville, was exonerated in the case. Charges against him were dismissed prior to indictment. Fonville had initially been arrested in connection with the burglaries, according to Sedita’s statement; however, further investigation showed he had “nothing to do with these crimes.”
