Man charged with drunken driving following a crash between two all-terrain vehicles

ROYALTON – A man injured in an all-terrain vehicle crash on Block Church Road at 9 p.m. Sunday was charged with drunken driving.

Nicholas L. Criswell, 27, of Ertman Road was charged with driving while intoxicated, leaving the scene of an accident and operating an unregistered ATV.

Criswell told deputies that he had about seven beers and then went riding on his ATV with four passengers. He said he was riding next to another ATV with passengers and they collided and lost control. He said he and his passengers were ejected and he was told that he lost consciousness.

Criswell said he was not wearing a helmet. The condition of the other driver and passengers is unknown.

Criswell said he returned home and called Rural Ambulance to his home It was determined that he had a large cut and bruises and needed further evaluation at Erie County Medical Center.

At ECMC deputies performed sobriety tests, and he was taken into custody. His ATV was impounded, according to deputies. A court date in the Town of Royalton was set for 5 p.m. Tuesday.
