LOCKPORT – Questions about the conduct of the victim’s ex-boyfriend led Niagara County Judge Sara Sheldon Farkas to impose the minimum sentence of three years in prison on a burglar Friday.
Edward J. Parmer, 52, of 22nd Street, Niagara Falls, had admitted to a reduced charge of attempted second-degree burglary in connection with the July 18, 2012, break-in at a woman’s home on Willow Avenue in the Falls. Computer games and a DVD player were among the items stolen.
Assistant Public Defender A. Joseph Catalano accused the woman’s ex-boyfriend of entering the home before Parmer did. Farkas commented that the uncharged ex tried to sell the stolen property back to the woman. “It casts a cloud over the case,” the judge said.
But state prison time was mandatory for Parmer because he is a repeat felon. He was ordered to repay the woman $1,100 after his release.
Parmer aborted his first trial March 11 by checking himself into Niagara Falls Memorial Medical Center’s mental health unit. He then pleaded guilty May 28, the day his retrial was to have begun. “Once my client became stable, he understood what he did was incorrect, was wrong,” Catalano said.
