Parolee admits violent break-in

A 30-year-old parolee has pleaded guilty to two counts of first-degree burglary for breaking into a Black Rock apartment and stabbing a mother and her 16-year-old son on Dec. 8, the Erie County District Attorney’s Office said Wednesday.

Marvell Belton of Hill Street faces up to 25 years in prison when sentenced on May 20.

He pleaded guilty before Erie County Judge Sheila A. DiTullio to the highest charges for which he could have been convicted had he gone to trial, District Attorney Frank A. Sedita III said.

A 10-year-old boy and three 17-year-old girls hid in a closet during the violent encounter, prosecutors said.

Belton broke into the Clay Street home at about 1:45 a.m., according to police. He broke the front door to gain entry, then broke down the bedroom door, according to a police report.

Belton stabbed the woman in the left side of her body with a large a large hunting knife, causing a large cut, police said. Belton then stabbed the son in his right forearm, his right hand, and near his left eye.

The victims were taken to Erie County Medical Center, where they were treated for their injuries, then released.

Belton ran from the scene and Buffalo police found him within minutes hiding nearby in a relative’s house.

Belton was convicted of attempted robbery in 2004 and has repeated parole violations since his 2007 prison release, according to the District Attorney’s Office.

A 15-year-old boy was arrested on second and third-degree assault charges in School 53 at 425 Hamburg Street today for allegedly knocking Assistant Principal Kimberly Janaski to the floor, causing her head injuries, and punching another student several times in the face during a cafeteria incident about 1:15 p.m.

Police did not release the juvenile offender’s name but said the school nurse treated Janaski and the injured boy for minor injuries.

NIAGARA FALLS – A woman told police Tuesday she found a bullet had struck the house in the 2200 block of Welch Avenue and then landed inside.

The woman told police she heard a gunshot at about 1:30 a.m., but did not call police. Later that day at about 5 p.m. she found a bullet on the floor in the front hallway and a bullet hole outside in a west wall.

Police said they received numerous calls of shots fired and got descriptions from witnesses of a man in dark trousers and a white shirt who had been shooting and then ran down Welch Avenue.

Help sought in locating suspects in death of 96-year-old man

Buffalo homicide detectives have released updated photographs of two young men wanted for questioning in the homicide of home invasion victim 96-year-old Levi Clayton.

Police are asking for the public’s help in locating Shaquar Pratcher, 17, and Elhajji Elshabazz, 22.

Clayton died last week and his death was ruled a homicide, the result of injuries he suffered in the Nov. 24 home invasion at his Longview Avenue residence.

Jordan McKinnon, 19, and Justice Feggans, 18, already have been arrested in connection with the fatal attack.

Clarence doctor faces additional charges of sexually abusing patients

ALBANY – A doctor from Clarence charged last year with sexually abusing a patient in his Depew office was arraigned Wednesday in Erie County Court in Buffalo on 17 additional counts after more witnesses came forward following publicity on the case, State Attorney General Eric Schneiderman said.

Dr. Dharam Paul Garg, 62, now faces one felony count of rape, five felony counts of criminal sexual acts and 11 misdemeanor counts of sexual abuse.

“Doctors who sexually abuse the patients in their care are guilty of a particularly heinous crime,” said Schneiderman, whose office has been handling the investigation and prosecution of the case. “I commend the bravery of the victims who came forward and will ensure that my office prosecutes this case to the fullest extent of the law,” he added.

An indictment against the doctor said he engaged in sexual acts in his Depew office with four different patients on multiple occasions. In one case, Schneiderman said, Garg is alleged to have had sexual contact with the same woman during five different appointments and sexual intercourse during a sixth appointment.

Garg, of Shimerville Road, was charged last December with sexually abusing a 49-year-old patient Nov. 9 in his Depew office. The Attorney General’s Office at the time said he signed a statement admitting to sexual relations with the woman over a two-year period.

The evidence against the doctor in that case included a video recording that the woman made on her cellphone.

The Attorney General’s Office said New York law states that patients cannot give consent to sexual conduct with a physician during an examination, consultation or treatment session.

Gowanda woman faces DWI, other charges, after traffic stop

Getting pulled over for speeding and driving on the shoulder of a road on the Cattaraugus Indian Reservation early today was only the beginning of trouble for a 21-year-old Gowanda woman, according to Erie County sheriff’s deputies.

Deputy Matt Krypel made the traffic stop about 3 a.m. on Southwestern Boulevard, where Kelly C. Mallaber was charged with driving while intoxicated after failing field sobriety tests. A breath test, performed at the North Collins substation, revealed a blood-alcohol content of .20 percent, deputies said.

The level of intoxication led to a charge of aggravated DWI, deputies said. Her driver’s license was suspended because of failure to answer a summons, leading to a charge of aggravated unlicensed operation.

Mallaber also was ticketed for speeding, driving on the shoulder of the road, having an open container of alcohol in a vehicle and obstructed view. Her vehicle was towed from the scene of her arrest, to be held for 12 hours, and she was released in her mother’s custody, pending an appearance in Brant Town Court.

Suspected Jamestown gunman arrested without incident

JAMESTOWN – A 34-year-old man suspected of firing a gun outside a city bar was taken into custody this morning without incident, police reported.

Officers were dispatched to the Roadhouse Bar, on East Second Street, at about 11:50 p.m. Wednesday after someone reported a man with a gun. Police determined that eight shots had been fired in a parking lot on the east side of the business.

After obtaining a search warrant, officers – including members of the department’s SWAT unit – went to the Curtis Street home of suspected gunman Zachiel Fields. The suspect wasn’t there, but police reported they found the weapon they believe was fired outside the bar.

Fields was taken into custody at about 9 a.m. today in a Utica Street apartment where he had been hiding, police said. Charged with felony counts of criminal possession of a weapon and reckless endangerment, he’s in the city lockup awaiting arraignment.




Tire with rim stolen in Newfane

NEWFANE — A 20-inch tire and rim valued at $450 were reported stolen after being left outside of an apartment in the 3900 block of Lockport-Olcott Road, sometime between 12:30 and 4:30 p.m. Wednesday.

The victim told Niagara County sheriff’s deputies that he left the tire with chrome rim outside his apartment door because there was not enough room inside his apartment.

Man caught smoking dope in jail

LOCKPORT – Authorities, led by the smell of marijuana smoke, made an arrest Wednesday night after finding an innmate in possession of the drug, who had allegedly been smoking in the Niagara County Jail.

William A. Jones Jr., 33, of LaSalle Avenue was found in his housing area just after 11 p.m. with two small baggies containing marijuana.

Jones was serving 90 days in jail after being sentenced in Niagara Falls City Court on marijuana charges. He will now face additional charges of unlawful possession of marijuana and promoting prison contraband.

NEWFANE – A corrections officer from the Niagara County Jail is one of a number of residents whose unlocked vehicles are being targeted by thieves in the Ketchum Avenue area.

The 61-year-old corrections officer told Niagara County sheriff’s deputies Wednesday that sometime betweeen 11 p.m. Tuesday and 8 a.m. Wednesday someone entered his unlocked personal vehicle while it was parked in his driveway and took his duty belt, handcuffs, flashlight, belt keepers, radio holster, gloves, and also the holsters for each piece of equipment. A GPS was also taken from the unlocked vehicle. Total loss was $331.

The victim said several of his neighbors have been victims of similar crimes over the past several weeks, but had not reported them. The victim asked for periodic checks of the area throughout the night.

Charges pending against four in Chautauqua County double homicide

MAYVILLE – In a case one veteran law enforcement officer described as one of the most disturbing he has ever seen, four men have been taken into custody in connection with the slayings of a Town of Carroll couple, whose bodies were discovered Wednesday inside their burning home.

Chautauqua County officials identified the victims as Gordon Skinner, 66, and his 59-year-old wife, Joyce, of Wheeler Hill Road home.

In custody are: Davide Coggins, 34, no address given; and Ricky Knickerbocker, 18; Steven Todd, 18; and Joshua McCormick, 21, all of Elmira. Authorities said they were picked up early Thursday in Elmira; Coggins was picked up separately and the other three were together.

Sheriff Joseph A. Gerace said the Skinners were killed during a home invasion.

“In all our minds, it was not a random act. We believe it [was] a targeted act,” he said.

“In my 34 years, this was one of the most disturbing and troubling home invasions I have seen,” the sheriff said.

Autopsies were performed Thursday morning by the Erie County Medical Examiner’s Office. Nothing was disclosed as to how the Skinners were killed – except that a firearm was not involved.

District Attorney David W. Foley said the four are being held in the county jail.

Police have seized a 2003 car – a gold or tan-colored Pontiac Grand Am with New York plates – in which the four were believed to have traveled together. Anyone who may have seen it as early as Tuesday in the Town of Carroll or Frewsburg is asked to call police.

“The community is extremely scared,” said Carroll Police Chief Timothy Wright. “We are doing everything we can to help the community. People should understand that their communication will assist us in solving this case and anything they think would help to clarify the situation, they should report it.”

State Police, Chautauqua County sheriff’s deputies, Elmira and Town of Carroll police were credited for their help with the continuing investigation.

No information was given on the cause of the fire or extent of damage to the house.

The couple was believed to have been alone in the house.

State corrections officer arrested for official misconduct

MAYVILLE -- A 52-year-old state corrections officer who lives in Dunkirk was arrested today by State Police working with the Chautauqua County District Attorney’s office on an investigation.

Christopher J. Ley, a corrections officer at the Lakeview Correctional Facility in Brocton was arrested on a misdemeanor charge of official misconduct following a two-month investigation. Ley is accused of getting improperly involved in a cigarette exchange scheme with inmates at the facility.

Ley has been ordered to appear in Portland Town Court for arraignment in several weeks. His current job status was not disclosed.

State Police Troop T targeting cell phone-using thruway drivers this coming week

Using a cell phone while driving on the Thruway could become very expensive this coming week.

State Police Troop T is gearing up to have increased patrols starting Monday all along the state thoroughfare during what its is labeling “Operation Hang Up” targeting drivers illegally using mobile devices. The stepped-up enforcement will begin Monday and continue through Sunday, April 28.

State Police officials said cell phone use and texting are responsible for a significant portion of all traffic crashes, injuries and deaths and the use of the devices continues to increase despite their obvious danger to motorists. Troop T has already made distracting driving enforcement a priority and last year of the 150,000 tickets the troop issued some 4664 of them were for cell phone violations. The Thruway Authority will be posing reminders on message boards throughout the Thruway system during the state police initiative next week.

Man who torched Falls house pleads guilty

LOCKPORT – A man who set fire to a condemned Niagara Falls house from which he had just been evicted pleaded guilty to two felonies Thursday in Niagara County Court.

William M. Bradley, 31, of Buffalo Avenue, admitted to reduced charges of attempted third-degree burglary and attempted second-degree criminal mischief. County Judge Sara Sheldon Farkas said she would allow Bradley to be screened for mental health and substance abuse treatment, and if he is accepted, she will place him on probation. Otherwise, he faces a two-year jail sentence.

The fire occurred Aug. 12 at 556 20th St.


Men charged with electronics store break-in

LOCKPORT – Two Niagara Falls men have been indicted in the Feb. 17 burglary of an electronics store.

Ramses Cruz-Cartagena, 22, of 17th Street, pleaded not guilty Thursday in Niagara County Court to third-degree burglary, fourth-degree criminal mischief and fourth-degree grand larceny.

On Monday, Xavier T. Faura, 18, of Portage Road, was arraigned on the same charges.

Jamarius D. Scott, 21, of Linwood Avenue, pleaded guilty April 3 to a reduced charge of attempted third-degree burglary. The trio are accused of stealing two laptops and five cellphones after smashing the window of NYC Jewelry and Electronics Outlet, 1605 Pine Ave.

Man who climbed through 12-year-old’s window admits to rape

LOCKPORT – A man who climbed a ladder to enter a 12-year-old girl’s bedroom and have sex with her faces up to 20 years in prison after pleading guilty Thursday to first-degree rape.

Michael D. Johnson, 28, of Crosby Avenue, Lockport, was jailed without bail to await sentencing June 28 by Niagara County Judge Sara Sheldon Farkas.

The incident occurred sometime last July in Lockport, Farkas said from the bench. Johnson had faced a 15-count indictment accusing him of having sex with the girl between July and October. The indictment featured a predatory sexual assault charge that carried a maximum sentence of life in prison.

Farkas told Johnson, “Your mother filed a complaint saying this 12-year-old girl raped you.” Johnson disclaimed responsibility for that statement. “I was the adult in the situation. I made some bad mistakes,” he said tearfully.

Falls man arrested in chase is indicted on gun charge

LOCKPORT – A man who allegedly was part of a Niagara Falls police car chase on New Year’s Day was arraigned Thursday in State Supreme Court on a charge of having a sawed-off shotgun.

Jheryl B. Carter, 24, of 12th Street in the Falls, pleaded not guilty to second-degree criminal possession of a weapon.

Police said they followed a car for several blocks after receiving a report of a man with a gun in the 1800 block of Michigan Avenue about 3 p.m. Carter, a passenger, got out when the car stopped. The other occupants fled on foot and got away. The shotgun was found in the auto.

Man robbed a gunpoint in his Niagara Falls home

NIAGARA FALLS – A 42-year-old Niagara Avenue man told police a man wearing a black ski mask forced his way into his home at gunpoint, beat him and robbed him of cash at 10 p.m. Wednesday.

The victim said someone knocked on his door and when he opened the door he was staring down the barrel of revolver. He said the man entered his apartment in the 1600 block of Niagara Avenue and demanded cash. He said when he told the man he didn’t have any cash the man hit him in the head with the revolver. The two men wrestled and the suspect took $120 from the victim’s pocket before he left, according to police.

The suspect was described as six feet tall, weighing 150 pounds. Police said they recovered black gloves believed to have been left behind by the suspect.

Copper pipe and wiring stolen from a newly renovated Falls house

NIAGARA FALLS – A house undergoing renovation in the 1800 block of Linwood Avenue was burglarized and about $1,300 worth of recently installed copper wiring and pipes were stolen, according to Niagara Falls police.

The 39-year-old victim told police Wednesday that he had installed $1,500 worth of copper wiring and found about $800 worth of the wiring had been stolen as well as $500 worth of copper pipe and a $150 wood saw.

The victim said the theft happened sometime since he had been in the house at 5 p.m. on Monday. Entry was made through a back window, police reported.
