Driver, passer-by arrested after DWI crash

Erie County sheriff’s deputies charged a Collins woman early today with driving while intoxicated after a one-car crash on Route 438 on the Seneca Nation Reservation. They also arrested a man walking nearby when, deputies say, he interfered with medical personnel at the scene.

Charged with driving while intoxicated is Kelsey L. Lay, 21, who was treated at the scene for minor injuries she suffered when her vehicle struck a utility pole. Deputies said she had a blood-alcohol content of .19 percent, more than twice the limit that triggers a DWI charge. She was ticketed to appear in the Town of North Collins Court at a later date.

Deputies also say that Steven E. Young, 28, of Lawtons interfered with medical personnel as he approached the accident scene on foot at around 4:20 a.m., then became hostile and struggled with deputies and Seneca Nation marshals. Young was taken to the county Holding Center on charges of disorderly conduct, obstructing medical emergency personnel, obstructing governmental administration and resisting arrest.

Four arrested when Jamestown melee spills into street

JAMESTOWN – A melee in Jamestown early Saturday led to the arrest of four people.

Jamestown police said the four arrived at 429 Lincoln St. after 2 a.m. looking to collect on a debt. When they forced their way into the home a fight broke out and spilled into the street.

Police arrived to find several people going at it. One was armed with a baseball bat, another with a shotgun. But no one was seriously injured, police said.

Charged with burglary and conspiracy are: Jonathan R. Ray, 21, and Chad T. Robbins, 21, of Falconer; and Casey R. Billyard, 20, and Kaitlyn N. Billyard, 18, of Jamestown. A fifth suspect fled, police said.

Police said they also charged the Billyards with assault and Ray with criminal possession of a weapon.

Rear-end crash leads to DWI charge

A driver who rear-ended another vehicle in Mayville was charged with driving while intoxicated.

Chautauqua County sheriff’s deputies said that when they responded to the accident on West Chautauqua Street in the village they found Jackson W. Nolloth, 28, of Hannum Road in Mayville, intoxicated. He was charged with driving while intoxicated and driving with a blood-alcohol content greater than .08 percent, and cited with following too closely and driving an uninspected motor vehicle. He was ticketed to appear in the Town of Chautauqua Court.

Deputies said Nolloth rear-ended another auto as it slowed to pull into a driveway at around 5:30 a.m. Friday.

Three arrested in beating of Lockport woman

LOCKPORT – City police charged three men with third-degree assault early today after a South Transit Street woman said she was beaten in the 100 block of Willow Street.

Arrested at about 3:45 a.m. were Dorian M. Polk, 20, of High Street, and Sheldon W. Allen III, 20, and Shamir W. Allen, 17, both of Washburn Street.

The victim said she heard noise outside and went out to investigate, and then was jumped by a heavyset woman, who started punching her before three men joined in. She identified the men as her assailants after police apprehended them.

The victim suffered a cut lip and a bruised and swollen face. She was treated at her home by Lockport paramedics.

Olean police shut down pot-growing operation

OLEAN – City police armed with a search warrant raided an indoor marijuana-growing operation Saturday night and seized a growing system and 220 pot plants.

Roman Gabriel, 34, of West Green Street, was charged with first-degree criminal possession of marijuana and unlawfully growing cannabis. He was held on $5,000 bail.

The 10:30 p.m. raid resulted in the seizure of plants that might have yielded $200,000 worth of marijuana, police said. The hydroponic growing system, valued at $10,000, was found in the house and garage, which police said were owned by his parents, Thomas and Mary Gabriel. Officers seized lighting, an irrigation and ventilation system and fertilizers.

An off-duty Depew police officer spotted two men inside the Marcy Casino at Delaware Park Lake early today, detaining one, while the other was captured a short time later on Elmwood Avenue. Charged with attempted third-degree burglary were Matthew T. Sirianni and Robert A. Herman, both 22, of Elmwood Avenue.

Northwest District police said Depew Officer Matthew Braun saw two men with flashlights inside the casino about 4:50 a.m. He entered and identified himself. He grabbed Sirianni, while Herman fled, running east through the park, and was captured at his apartment.

Man with rifle arrested outside West Chippewa bar

A man who witnesses said threatened to “shoot up” a West Chippewa Street bar was arrested about 3 a.m. Sunday after police found a loaded rifle on the front passenger seat of his vehicle.

Central District police charged Darnell Pearsell, 27, of Center Lane, with second-degree criminal possession of a weapon, a Class C felony. Officers said Pearsell had been ejected from 4Play, 45 W. Chippewa St., a few minutes before they received a call about a man with a gun.

Inside a West Chippewa bar about 10 minutes earlier, Teurel Grant, 23, of Theodore Street, had been arrested and charged with punching a woman in the face. The victim said Grant had allegedly dragged a female friend of hers across the club by the arm, and she was punched when she tried to intervene. A police officer saw the altercation. Grant was charged with third-degree assault, unlawful possession of marijuana and harassment.

Canadian police on apparent Falls suicide

NIAGARA FALLS, Ont. – A person was reported going over the Horseshoe Falls on the Canadian side of Niagara Falls Saturday night, Niagara Parks Police confirmed.

Police said no body was found below the Falls and they said no further information on the incident would be released.

Two hurt in Grider Street crash

Two persons were injured about 6:15 p.m. Sunday in a three-vehicle collision at Grider Street and Pembroke Avenue.

Buffalo Police spokesman Michael DeGeorge said a vehicle traveling east on Pembroke struck a second vehicle that was heading south on Grider. The eastbound car then crashed into a third vehicle, which was stopped at the intersection, waiting for a red light to change.

Those injured included a 62-year-old woman who was driving the eastbound car. DeGeorge said both injured persons were taken to the nearby Erie County Medical Center, where their injuries were not considered life-threatening. No charges were immediately filed.

Woman charged in scissors stabbing

A woman was charged with felony assault Sunday morning after she allegedly stabbed another woman in the face with a pair of scissors.

South District police said they arrested Teresa Dolan, 48, of South Park Avenue, about 8:15 a.m. after the incident with a 49-year-old woman in Dolan’s home. Dolan was charged with second-degree assault and fourth-degree criminal possession of a weapon.

The victim suffered a laceration, police said.

Davis sentencing delayed as attorney seeks to cancel verdict

LOCKPORT - Today’s scheduled sentencing for Matthew A. Davis, convicted of felony murder in connection with the death of a Niagara Falls man, was postponed as defense attorney Michael S. Deal filed a motion to overturn the jury’s verdict.

Niagara County Judge Matthew J. Murphy III reserved decision on the motion, which was opposed by Deputy District Attorney Doreen M. Hoffmann. Murphy rescheduled sentencing for April 18 - unless he grants the motion for a new trial.

Davis, 37, never was charged with intentionally killing Antoine M. Bradberry, 41, in the latter’s apartment on Rainbow Boulevard in Niagara Falls.

Instead, Davis was charged with felony murder by causing Bradberry’s death in the course of committing another felony - in this case, robbery.

Davis allegedly used two women to scope out Bradberry’s apartment Aug. 22, 2011, before entering and trying to steal a cache of marijuana.

The jury deliberated less than two hours before convicting Davis on Dec. 7.

An autopsy ruled that Bradberry’s death was caused by “hypertensive cardiovascular disease,” but the manner of death was left undetermined. He also was found to have a broken nose and jaw.

Police officers who went to the scene after Bradberry’s father discovered the body said there was a large amount of blood spattered around the apartment.

Deal, who defended Davis along with Philip Dabney Jr., argued the evidence was insufficient to prove Bradberry’s death was caused by anything Davis might have done.

“There has to be a direct link between the defendant’s actions and the death,” Deal argued.

“There was no blunt force trauma that caused his death, that’s true,” Hoffmann replied. “It was the stress on his heart caused by this violent struggle that caused his death.”

Deal said the autopsy was done by Dr. Jonrika Malone, who was, as Deal put it, “excused” from the Erie County Medical Examiner’s Office for failing a test.

Thus, Malone did not testify at the trial - Medical Examiner Dr. Diane Vertes did so - but Hoffmann said the defense passed up an opportunity Murphy offered to subpoena Malone.

“They want her conclusions, but they don’t want to bring her back [to testify],” Hoffmann said.

Prosecutors showed the jury video clips from the Jefferson Apartments’ surveillance cameras. They showed a man with a white T-shirt over his face heading toward Bradberry’s apartment.

One of the women involved in the case, Teara D. Fatico, testified that was Davis.

Deal said the man who operated the surveillance system said when the images were downloaded, “glitches” resulted that made people appear and disappear abruptly. Hoffmann said the defense didn’t object until the jury had seen the video, and then it was too late.

Murphy said Deal and Dabney “did a very excellent job of trying to exploit the glitches” at the trial.

Deal also said Davis told him that after Murphy dismissed the two alternate jurors at the start of deliberations, they were seen sitting on the Bradberry family’s side of the courtroom during the jury’s return to ask Murphy some questions.

Davis thought that choice of seating might have influenced the regular jurors, but Hoffmann said no one objected at the time.

“At that point, they’re basically free agents,” Murphy said of the alternates.

Fatico, 23, who pleaded guilty to attempted first-degree burglary and was sentenced to 13 years in prison, testified she had been having a sexual affair with the married Davis.

She testified that Davis was in her bedroom when she received a Facebook message on her smartphone from Bradberry, who asked her to visit him.

Fatico said Davis directed her to visit Bradberry and find out if he had anything to steal.

Fatico said she called a friend, Chastity L. Wilson to come along. Wilson, 23, refused to testify at Davis’ trial, even though she agreed to do so when she accepted the same plea deal as Fatico.

Buffalo man admits robbing banks in Kenmore, Hamburg

A Buffalo man has pleaded guilty to charges that he robbed banks in Kenmore and Hamburg in 2010, U.S. Attorney William J. Hochul, Jr. announced Monday.

Timothy Ernle, 51, entered the plea before U.S. District Judge Richard J. Arcara. The charge carries a maximum penalty of 20 years in prison and a $250,000 fine.

U.S. Attorney Melissa M. Marangola, who is handling the case, said that in July 201 Ernle robbed the M&T Bank branch on Delaware Avenue in Kenmore and the Evans National Bank on South Park Avenue in Hamburg on two separate occasion.

During all three robberies, the robber wielded a baseball hat and wore latex gloves and a stocking over his face. Ernle jumped over the teller counters and emptied the drawers.

Ernle, who is currently serving a state prison sentence for a bank robbery in Niagara County, stole approximately $27,000 during the three robberies.

The plea is the result of an investigation by special agents of the Federal Bureau of Investigation, under the direction of Special Agent in Charge Christopher M. Piehota.

He will be sentenced by Arcara on Oct. 18.

Paralegal gets prison time for stealing $311,000 from client

Pamela M. Blood, who admitted stealing $311,000 from a 77-year-old Grand Island heiress who had hired her to manage her finances, was sentenced this morning to state prison, after Erie County Judge Thomas P. Franczyk refused to buy into an argument that a medication contributed to the woman’s thievery.

Blood, 56, was sentenced to 16 months to four years behind bars for writing checks to herself from Patricia Rupp’s accounts, in order to support her gambling addiction and finance her husband’s trucking business. Rupp hired Blood, a paralegal, to work part time for her after her husband, a construction company owner, died seven years ago.

Blood pleaded guilty last October to second-degree grand larceny and first-degree offering a false instrument for filing. She could have been sentenced to up to 19 years in prison.

Anthony J. Lana, her attorney, asked the court for a sentence of probation, explaining that Blood, who is extremely remorseful, took a prescription medicine known as Mirapex for restless leg syndrome and that one of the known side effects of the drug is that it promotes compulsive behaviors, such as gambling.

Franczyk pointed out that the “systematic” thefts began before Blood started taking the medicine. Blood has paid back $100,000 of the money she stole and is legally obligated to pay back the rest of the money she stole.

Silver Creek woman held as alleged Dunkirk cocaine pusher

DUNKIRK – A 32-year-old Silver Creek woman is being held in the Chautauqua County Jail on multiple counts of criminal possession and criminal sale of a controlled substance in the third degree filed against her by a Chautauqua County grand jury for alleged cocaine sales in Dunkirk, the Southern Tier Regional Drug Task Force reported today.

Christy M. Smathers, of Hickory Street, Silver Creek, was arrested by Silver Creek Village Police on a grand jury warrant linked to a continuing investigation of Dunkirk-area cocaine trafficking. Task Force spokesmen said Smathers is charged with selling quantities of cocaine to Task Force undercover agents numerous times over the past two months. Further arrests are expected in the continuing investigation.

Fresh indictment unsealed against convicted sex offender

LOCKPORT – A Niagara Falls sex offender, awaiting sentencing for three felonies, was arraigned Monday in Niagara County Court on a new indictment accusing him of a series of sex acts with an underage girl in the Falls last year.

Derrick J. Houser, 26, formerly of Cedar Avenue, is charged with second-degree criminal sexual act, two counts of third-degree criminal sexual act, and single counts of third-degree rape and endangering the welfare of a child.

Assistant District Attorney Robert A. Zucco said the alleged victim was 14 when the crimes allegedly began in March 2012 and had turned 15 by the time of the last of four alleged incidents in early May.

Houser, a Level 1 sex offender, pleaded guilty March 8 to two counts of failure to register. He moved to Detroit last June without telling police, and also failed to disclose his Facebook account. Those violations constituted a violation of the terms of his probation for his original offense of attempted first-degree sexual abuse in 2009. He is scheduled for sentencing May 10 on those three felonies.

Canadian man arrested while trying to sneak into states

A 41-year-old Toronto-area man is being held on a federal charge of eluding inspection for allegedly hiding in the trunk of a car that was inspected by U.S. Customs and Border Protection agents Sunday evening at the Peace Bridge.

Demetry Furman was ordered held on immigration charges after his arraignment in U.S. District Court in Buffalo this morning.

Furman had previously been denied admission to the United States because of a Canadian criminal record, agents reported. A spokesman for the Customs and Border Protection service said charges are being considered for the driver of the vehicle in which Furman was hiding behind some luggage.

JAMESTOWN – A Jamestown man and a Rochester couple are being held on weapons and stolen property charges following their arrest on Harrison Street behind the Big Lots store there about 2:30 p.m. today. One of the suspects was observed getting into a silver car as police officers arrived to investigate a gun incident.

Police stopped the car near the Arterial and South Main Street moments later. Bruce J. Miles, 24, of Rochester, fled the car but was quickly captured and charged with obstructing governmental administration. The driver of the car, Shamelle D. Warren, 21, of Rochester, was charged with obstructing justice and aggravated unlicensed driving.

A passenger in the car, Demarco Lathan, 24, of Jamestown, was charged with felony weapons possession after officers found a loaded handgun near him in the vehicle. All three are being held in the Chautauqua County Jail.

BROCTON – A 56-year-old Brocton man is being held on charges of aggravated unlicensed driving and unlicensed operation of a motor vehicle stemming from his arrest on East Main Street here about 10:45 p.m. today. John E. Sogger was arrested by Chautauqua County sheriff’s deputies after he was stopped for a routine traffic check and his history of prior alcohol-related driving convictions was determined. He was remanded to the county jail after his arraignment in Brocton Village Court today.

Taxi driver accused of fighting with customer and driving off with her money

NIAGARA FALLS – A Niagara Falls woman told police that a cab driver pulled her out of the backseat of his taxi, forcibly grabbed her money and then drove off, taking $38 just after 9:30 p.m. on Sunday.

Nounou Barry, 19, of 19th Street, a driver for Blue United Taxi was charged just after 11 p.m. with felony fourth-degree larceny after police questioned Barry and his manager.

The manager said it was against company policy to grab money from fares and get into physical altercations over fares.

The victim told police that she had disagreed with Barry about a $5 fare. She said he also grabbed her cell phone, but he gave it back and then drove off with her $38 in cash.

Witnesses said they saw Barry struggling with the victim in the cab and saw him push her down and drive away.
