Attica High student arrested for menacing teacher

WARSAW – A 17-year-old Attica High School student was arrested at the East Main Road school Thursday afternoon and charged with third-degree menacing for allegedly threatening a teacher and the teacher’s family.

Sgt. Colin Reagan and Investigator Aaron Anderson of the Wyoming County Sheriff’s Office obtained an order of protection for the teacher.

The student was released to the custody of his mother and has been ordered to appear in Attica Town Court for further proceedings on April 14. The student, whose name was not released, was suspended from school.

Geneva man rejects plea deal in multi-child sex abuse case

LOCKPORT – A Level 3 sex offender on Friday rejected for the second time a plea offer that would have limited his prison time in a triple child-molestation case to 25 years.

Sean M. Vickers, 44, of Geneva, faces life in prison as the maximum sentence if he is convicted of all charges in a trial set to begin April 7 before Niagara County Judge Sara Sheldon Farkas.

Vickers is charged with molesting three children in the Barker and Middleport areas between August 2012 and last March. In Genesee County, he faces similar charges involving five children, some of them the same victims as in the Niagara County case. A trial date there is to be sent in a March 6 court appearance, Genesee County District Attorney Lawrence Friedman said.

Vickers’ Niagara County attorney, Assistant Public Defender A. Joseph Catalano, said that in preparation for the trial, he is awaiting a copy of the hard drive of Vickers’ home computer and a download from Vickers’ cellphone.

Falls man admits to house burglary

LOCKPORT – A man who broke into a home on Willow Avenue in Niagara Falls on July 27 pleaded guilty to a reduced charge Friday in Niagara County Court.

Donald E. Rubin, 43, of 16th Street in the Falls, faces up to seven years in prison for attempted second-degree burglary. County Judge Sara Sheldon Farkas scheduled sentencing for May 2.

That sentence will include as much as $300 in restitution for damage to a DVD player and an Xbox system. All the stolen property was recovered by police, Assistant District Attorney Claudette S. Caldwell said.

Lockport woman takes plea in painkiller case

LOCKPORT – Brandi N. Cuillo, who was indicted on charges of making two sales of painkiller pills last June, was allowed to plead guilty to a misdemeanor Friday.

Niagara County Judge Matthew J. Murphy III scheduled sentencing April 11 for Cuillo, 30, of Lincoln Avenue, Town of Lockport. Cuillo was living on Robinson Road in that town on June 20, when she allegedly sold oxycodone and morphine in her apartment. She also was charged with selling more oxycodone five days later.

Cuillo could draw up to a year in jail for seventh-degree criminal possession of a controlled substance.

North Tonawanda teen takes plea deal in near-fatal stabbing

LOCKPORT – A North Tonawanda 17-year-old was promised youthful offender status Friday as he pleaded guilty in connection with the near-fatal stabbing of another teen during an Oct. 5 drinking party.

The boy, who was originally charged with attempted murder, pleaded guilty to attempted second-degree assault. Niagara County Judge Sara Sheldon Farkas told him he could still go to prison for as long as four years despite the youthful offender ruling. Sentencing was set for June 6.

Police said the suspect was playing beer pong with a Lockport 17-year-old in a home on Hagen Avenue in North Tonawanda. After losing a round, the defendant got a 7-inch knife from the kitchen and stabbed the victim four times: twice on the top of the head, once in the back of the head and once in the upper shoulder near the neck.

Monroe County man arraigned on Lockport drug charge

LOCKPORT – A Monroe County man, who allegedly had cocaine in his pocket when his car was pulled over Sept. 25 in the Town of Lockport, pleaded not guilty Friday in State Supreme Court.

Marquis J. Caliz, 24, of Gates, is charged with fourth-degree criminal possession of a controlled substance for allegedly having more than one-eighth of an ounce of the drug.

Probation violator who went to Florida is sent to prison

LOCKPORT – A Niagara Falls woman who moved to Florida after admitting to her third probation violation in a stabbing case was sentenced to one to three years in state prison Friday by Niagara County Judge Sara Sheldon Farkas.

Latoya Lane, 33, had pleaded guilty to a reduced charge of attempted second-degree assault for the Nov. 9, 2006, knife and bottle attack on another woman, not far from Lane’s 18th Street home.

Farkas placed her on five years’ probation, a term that was extended because of repeated violations. A bench warrant was issued after Lane failed to show up for sentencing in September 2012. Friday, Assistant Public Defender A. Joseph Catalano said Lane went to Florida to handle some family issues.

Car rams into Sheridan Drive optical business

A driver lost control and rammed into the Sheridan Drive side of the Stanton Optical business at Niagara Falls Boulevard and Sheridan, injuring one worker, about 9:30 a.m. Friday, according to Town of Tonawanda police.

The worker, who remained conscious but was shaken up, was taken for medical treatment.

The business was closed for a damage assessment and the start of repair work.

The driver, whose name has not been released, has not been charged. The accident remains under investigation.

Two men hit in apparent drive-by shooting on East Delavan

Two men were shot, one of them reportedly suffering serious injuries, at about 8:30 p.m. tonight at East Delavan Avenue and Schuele Street, Buffalo police report.

Both men were taken to Erie County Medical Center for treatment.

Police believe the incident was a drive-by shooting. Homicide detectives joined uniformed officers at the scene.

Additional details were not immediately available.

Former Lockport woman admits to gun possession in Falls homicide

LOCKPORT – Cammesoa M. Williams, who prosecutors said fired a gunshot at a Niagara Falls woman after the woman was fatally shot by Williams’ boyfriend, accepted a plea offer Friday in Niagara County Court.

Williams, 43, of Winston-Salem, N.C., pleaded guilty to a reduced charge of attempted second-degree criminal possession of a weapon. She could be sentenced to as long as seven years in prison when she returns before County Judge Matthew J. Murphy III on May 2.

That’s the same day that Williams’ boyfriend, Richard H. Moore, 50, of Winston-Salem, will be sentenced for first-degree manslaughter. He pleaded guilty to that charge last week.

Moore gunned down Tijuana Davis, 39, in the victim’s apartment on North Avenue in Niagara Falls on Sept. 28. Moore and Williams, a Lockport native, were in Niagara Falls to attend a wedding and were expected to stay with Davis, a friend of Williams.

Moore’s attorney, Assistant Public Defender A. Joseph Catalano, said Davis and Williams got into an argument over drugs and money. Moore shot Davis once in the stomach.

Williams’ subsequent shot missed the victim.

Murphy agreed to Assistant District Attorney Cheryl L. Nichols’ request that Williams have no contact with Davis’ family as a condition of remaining free on $5,000 bail.

Defense attorney Herbert L. Greenman said Williams spoke to Davis’ daughter, expressing regrets. “This has weighed very heavily on her,” Greenman said of Williams.

Williams volunteered information about her relationship with the victim’s daughter, telling the judge, “I helped raise her from a little kid. She still calls me Mom.”

Girl, 14, still in intensive care following 3-vehicle crash in Wheatfield

A three-vehicle collision involving an NFTA bus, a car and SUV Thursday night in Niagara County sent four people to area hospitals, including a 14-year-old girl who is in the intensive care unit at Women & Children’s Hospital today, authorities said.

The crash occurred at the intersection of Niagara Falls Boulevard and Williams Road in Wheatfield at 9:36 p.m. Authorities said the bus, which did not have passengers, was headed northbound on Williams across the intersection bound for nearby Niagara Falls International Airport while the car was eastbound on the boulevard.

“Two witnesses said the bus was proceeding with the green light at the intersection when the accident occurred,” said C. Douglas Hartmayer, spokesman for the Niagara Frontier Transportation Authority, stressing that the investigation was continuing and findings are preliminary at this point.

The SUV, stopped at the traffic light in the westbound lanes of the boulevard, was then struck, according to Hartmayer, who said charges are pending.

All three drivers were uninjured, but two of the three children in the 1999 Volvo, including the 14-year-old, were taken to Women & Children’s in Buffalo. The other child was taken to Mount St. Mary Hospital, Lewiston.

John Moscato, spokesman for Women & Children’s, said the family has requested that the conditions of the teen and other child taken there not be released.

Hartmayer, who declined to release the names of the injured because they are minors, said, “One of the children was more seriously injured than the other.”

A front seat passenger in the 2013 Toyota SUV was taken to Mount St. Mary, he said.

Amherst man arrested for marijuana possession

A 40-year-old Amherst man was arrested on marijuana possession and trespassing charges Thursday night in a store at East Ferry Street and Goodyear Avenue.

Anthony Page of Fairgreen Drive was charged with criminal possession of marijuana in public. He was also charged with trespass for being in the store without a purpose about 11:10 p.m.

Suspected robber nabbed in East Tupper Street alley

A 19-year-old East Delavan Avenue man was arrested at about 12:30 a.m. Friday in an East Tupper Street alley just after he allegedly robbed a Batavia man of rings, a necklace, a watch, $34 in cash and a bus ticket.

Jamel E. Baxter was charged with a felony count of second-degree robbery and criminal possession of stolen property after police driving past the alley spotted him and found the victim’s belongings in Baxter’s pants pockets.

Woman suffers severe leg injury when hit by delivery van

A Buffalo woman was rushed to Erie County Medical Center with a serious leg injury when she was struck by a delivery van at about 12:30 p.m. Friday at Bailey Avenue and Dingens Street, Buffalo police said.

The van had collided with a car making a left turn, careened into a nearby parking lot and struck the woman.

The woman’s name was not released by Buffalo police and no charges had been filed by Friday night.

The investigation is continuing.

Man wounded in East Delavan drive-by shooting dies at ECMC

A 32-year-old Buffalo man shot Friday night at East Delavan Avenue and Schuele Street has died at Erie County Medical Center, Buffalo police reported.

A 23-year-old Buffalo man also shot in the incident was treated and released.

The shootings occurred at about 8:30 p.m. Friday.

Police believe the incident was a drive-by shooting.

Police did not release the identities of the two.

Seven homeless after fire on Woodlawn Avenue

A fire routed seven residents early today from their two-story apartment house near Jefferson Avenue.

Buffalo police officers who arrived first on the scene reported that some residents were jumping from the windows of the apartment house at Woodlawn Avenue and Welker Street, according to investigators with the Buffalo Fire Department.

One resident sustained minor injuries and was treated and released at Erie County Medical Center, fire officials said. The blaze was reported at about 12:30 a.m. in the apartment. The fire started on the second floor and spread to the first floor. The cause is under investigation.

Damage was estimated at $160,000 to the building and $80,000 to the contents.

The American Red Cross Serving Erie and Niagara Counties provided vouchers for food, clothing and shelter for the residents.

Blasdell woman accused of DWI after avoiding rabbit in road

A Blasdell woman was arrested early Saturday on drunken driving charges in Orchard Park after her car went off the road, hit a mailbox and got stuck in a snowbank.

Dawn Ferrari, 42, was taken into custody at about 6:30 a.m. after a homeowner saw her walk away from the car, which was in a snowbank on Sheldon Road, west of Abbott Road.

Officer Joseph Rizzo stopped Ferrari as she was walking at Sheldon and Abbott. Police said she told him she had swerved to avoid a rabbit and went off the road.

She was charged with driving while intoxicated and aggravated DWI after a breath test showed her blood-alcohol content was 0.22 percent, nearly three times the 0.08 percent minimum for DWI.

Four charged after disturbances at University District intersections

Four men were arrested early today in disturbances at two Main Street intersections in the University District.

Antonio Taylor, 23, of Custer Street, and Quincy Sanford, 24, of Parkridge Avenue, were charged with inciting to riot and resisting arrest after a crowd gathered shortly after 5 a.m. at Main and Minnesota Avenue.

Police said Taylor whipped the crowd into a frenzy, started fights and refused police requests to disperse and refused to be handcuffed. He also was charged with obstructing governmental administration, disorderly conduct and second-degree harassment.

Police said Sanford fled the scene and was arrested nearby on Custer.

Two others were arrested at Main and Winspear Avenue after police said they were told by officers several times to disperse and refused, shouting obscenities at the officers and pushing past them.

Jake Schechter, 21, of South Salem, in Westchester County, and Robert E. Pawlewicz, 21, of Camillus, near Syracuse, were charged with obstructing governmental administration, resisting arrest and disorderly conduct.

Police did not say if the two disturbances were related.

Two seriously injured in Chautauqua crash

Two drivers were seriously injured in a crash early Saturday morning in Sherman, Chautauqua County deputies reported.

The two vehicles were traveling on Pelton Road about 2:30 a.m. when the crash occurred head on, deputies reported.

Both drivers had to be extricated with the aid of special tools and they were flown by Starflight and Stat Medivac to Hamot Medical Center in Erie, Pa.

A passenger in one of the vehicles was transported by ambulance to Hamot.

Volunteer fire departments from Sherman, South Ripley and Mayville responded.

The Sheriff’s Office accident reconstruction team was called and an investigation is continuing.

Names will not be released until later today, deputies said.,

Two shot after leaving bar on William Street

Two Buffalo men were shot after they left a William Street bar early Saturday.

Antoine Worthy, 26, told police he and three friends left the Cheap Shots Bar at 2:14 a.m. and saw a man standing behind a truck. He said they then heard three gunshots and started running. He said he felt a burning sensation in his left foot and realized he had been shot.

Police said the other victim, Zandell M. Kirkland, 22, was shot in the left calf.

Both were taken to Erie County Medical Center for treatment.
