Tonawanda man robbed in Allentown parking lot

A Tonawanda man was robbed early Sunday in Allentown by two men he had been drinking with, Buffalo police reported.

The victim said he was attacked around 1:14 a.m. in a parking lot west of the intersection of Elmwood Avenue and Allen Street, according to a police report. He was forced to hand over his cell phone and wallet containing personal papers, credit card and $100 cash. He suffered injuries to his right elbow in the struggle.

A police camera at the intersection did not capture any usable images because it was obstructed by rain at the time.

Backseat passenger dies in Buffalo crash

One man was killed and two others injured in an early morning crash Sunday at the ramp to the Kensington Expressway near Elm Street, Buffalo police reported.

The fatal crash occurred just before 3:30 a.m. when a vehicle, possibly traveling at a high rate of speed, struck a curb guard rail and a tree before coming to rest on some nearby grass.

Buffalo Police accident investigators were continuing to probe the cause of the crash which killed a back seat passenger who was ejected from the vehicle. The victim was taken to Erie County Medical Center, where he later died.

The driver of the vehicle, as well as another passenger, were also taken to ECMC, where they were treated later Sunday for “non-life-threatening injuries,” according to police.

Authorities did not reveal the names, ages or addresses of those injured in the crash.

Domestic dispute leads to multiple charges for Delevan man

DELEVAN – A Delevan man faces a slew of criminal charges after allegedly head-butting, pushing and threatening a woman during a domestic dispute at his home late last week, State Police reported.

Nathan C. Biehl, 28, was arrested Friday on charges of harassment, menacing as well as endangering the welfare of a child because of the incident, which allegedly took place in the presence of a young child, troopers said.

Biehl was arraigned in Yorkshire Town Court and taken to Cattaraugus County Jail in lieu of bail.

Boys robbed of their cell phones on Dartmouth

The parents of the boys told police they were walking on Dartmouth when they were approached by four males who asked them to use their phones. After obtaining both of the phones from the boys, the suspects allegedly motioned to their waistlines and told the victims that they “can’t dodge a bullet” before the robbers fled toward Comstock Avenue.

No weapons were apparently displayed.

Northeast District Police were investigating the report.

Two youths arrested for attack on juvenile with autism

Two juvenile males were arrested early Sunday on South Lane in connection with an attack on another juvenile with autism, according to Buffalo Police reports.

The suspects allegedly punched the autistic boy in the face and stomach and tried to steal his bicycle at about 11 p.m. Saturday, police reported.

Northwest District Police investigated and tracked down the suspects a short time later. They face a variety of charges.

The names of the suspects were withheld because of their age.

Water main ruptures on South Park Avenue in Buffalo

A portion of a South Buffalo neighborhood was without water Sunday following the rupture of a water main on South Park Avenue, according to Buffalo city officials.

An area of South Park between Abbott Road and Spaulding Street was closed down to traffic while crews from the city’s Department of Public Works tended to the water main break.

The cause of the break remained unclear late Sunday.

Water service was starting to be restored as of about 10 p.m.

Concert disturbances lead to eight arrests at Darien Lake

Eight adults from Western New York and southern Ontario have been arrested for either trespassing or disorderly conduct during the Zac Brown Band Concert at Darien Lake Performing Arts Center on Sunday, Genesee County sheriff’s officials reported.

The eight people arrested were accused of various offenses, including jumping a fence into the concert venue, causing a disturbance or re-entering the concert venue after being ejected. Both trespassing and disorderly conduct are violations.

Five of the eight people arrested are in their 20s; the others are 35, 50 and 53.

Deputies also charged 30 youths under 21 with possession of alcohol with intent to consume.

Motorcyclist dies of crash injuries suffered last week

Motorcyclist Rafael Maldonado Jr., 43, died today at Erie County Medical Center of the several injuries he suffered in a crash with a minivan in the 300 block of Grider Street last week, Buffalo police said.

Maldonado’s helmet was reportedly knocked off when he crashed at about 2 p.m. Wednesday. He apparently underwent an emergency tracheotomy at the scene of the accident. He had been in critical condition at the hospital.

Ronald James Smith, 63, the minivan driver remained in improved serious condition at ECMC.

The Buffalo Police accident investigation unit is probing the crash.

Rochester man sentenced for stealing scrap steel from Batavia rail yard

A Rochester man was sentenced Monday to 18 months in prison for stealing scrap steel from a CSX rail yard in Batavia four years ago.

Anthony Toscano, 48, had previously been convicted during a trial in U.S. District Court in Rochester of conspiracy to steal an interstate shipment and theft of an interstate shipment.

Prosecutors said Toscano, along with co-conspirators Richard E. Riedman, Anthony Russell and Timothy Stone, used a logging truck to remove more than 17 gross-ton bales of high-grade scrap steel from a railcar in the yard.

Toscano’s sentencing is the result of an investigation by the FBI and Genesee County Sheriff’s Department.

West Falls man’s death ruled accidental

The body found by East Aurora Police Friday afternoon in Cazenovia Creek about 150 feet below a cliff in the 1700 block of David Road, West Falls was identified by police officials today as Luke Tarnacki , 22, of West Falls.

Tarnacki’s body was recovered by East Aurora Police Lt. Shane Krieger with assistance of the West Falls Fire company. Detective Rick Daminski told The Buffalo News the investigation disclosed Tarnacki had been walking along the cliff’s edge when he apparently lost his footing, slipped into a natural drainage wash at the edge of the cliff and then fell approximately 150 feet to his death.

An autopsy conducted today by the Erie County Medical Examiner lead to a ruling that the death was accidental.

Tourists vehicles targets in Falls

NIAGARA FALLS – A number tourists reported vehicle break-ins over the weekend.

A Texas family flagged down police at 1 p.m. Sunday at Buffalo Avenue and Third Street to report a vehicle break-in. They said they had stopped for an hour to visit the Falls.

The front and rear windows of the Honda Suburban were smashed. Among the items stolen were two bags that contained an iPad mini, iPad 2 and iPod touch, wallet, credit cards, birth certificates, blue tooth speakers, DVD, camera, three hard drives, driver’s license and all four passenger’s passports.

A credit card company said the credit cards had already been used for purchases in Buffalo.

In another case a vehicle break-in was reported between 8 and 9:30 p.m. Sunday in a vehicle in the Denny’s parking lot at 443 Main Street.

A South Carolina man said he had stopped to eat with his family and when he returned to his Chevrolet Suburban he found the lock smashed and a laptop, Kindle, and two iPads had been stolen.

Traffic stop leads to repeat DWI offender

NIAGARA FALLS – A man with a history of drunken driving and a revoked license was charged with felony drunken driving at 8 p.m. Sunday in the 500 block of 22nd Street, police said.

Aaron Potter, 30, of Linwood Ave, was charged with failure to obey a traffic control device, aggravated unlicensed operation, no inspection, no registration, and no insurance.

He was also charged with felony driving while intoxicated because he has a previous DWI conviction.

Police described Potter as uncooperative and he faced an additional charge for refusing to be screened.

After being booked Potter complained of back pain and illness that appeared to be related to intoxication. He was taken by ambulance to Niagara Falls Memorial Medical Center for treatment, according to police.

Two teens plead guilty to weapons possession

Two Buffalo teens have pleaded guilty to criminal weapons possession in connection with a January traffic stop during which Buffalo police found a sawed-off shotgun, a revolver and two pistols – all of which were loaded.

Pleading guilty to second-degree criminal possession of a weapon were Christopher N. McCleary, 17, of 1503 E. Delavan Ave. and Girard Jackson, 18, of 281 Berkshire St.

The charge is the highest for which the defendants could have been convicted if they had gone to trial.

A third defendant in the case, Christopher D. McCleary, 45, who is the uncle of the younger McCleary, posted bail following the arrest and fled. A warrant has been issued.

The three were traveling together when their vehicle was stopped by police on Jan. 23.

Assistant district attorneys John P. Feroleto and Paul C. Parisi prosecuted the case.

The younger McCleary and Jackson will face a maximum prison sentence of 15 years when they are sentenced July 24.

DePetris wants to tell part of his story, attorney says

LOCKPORT – Timothy C. DePetris, the Niagara Falls businessman accused of shooting a rival business owner who was also his brother-in-law, and then of trying to hire a hit man to kill the victim, may be willing to testify regarding some of the charges against him, his lawyer said Monday.

DePetris, 44, is charged with shooting Sandro Viola at the latter’s office March 26. He was arrested four days later, when police said he had an automatic rifle and large quantities of ammunition in his car.

While in the County Jail, tapped phones allegedly caught DePetris on tape trying to hire a hit man, leading to a second indictment. Prosecutors said they want the two indictments combined, but defense attorney E. Earl Key said he wants the incidents in the first indictment – on the shooting and weapons possession charges – broken into separate trials.

Key said he’d like Niagara County Judge Sara Sheldon Farkas to hear DePetris’ story in private, but Farkas replied that she would have to hear a lot more detail to grant such a request. She said Key seemed to be saying DePetris wants to testify regarding one indictment but not the other.

Farkas ordered the attorneys to prepare more detailed legal papers and to return to court Aug. 23. She also imposed a gag order, barring the lawyers from commenting about the case to reporters.

Passenger killed in crash identified

Jireh D. Williams, 21, of Buffalo, has been identified as the passenger killed in the early morning Sunday motor vehicle crash at the ramp to the Kensington Expressway near Elm Street, police said today.

Williams, a back seat passenger, was thrown from the vehicle just before 3:30 a.m. when it struck a guard rail and a tree before coming to rest on some nearby grass. Police accident investigators are continuing to probe the cause of the crash, which may have involved speeding.

The driver of the vehicle and another passenger were taken to Erie County Medical Center, where they were treated for “non-life-threatening injuries,” according to police.

Plea deal possible in attempted murder of 7-year-old

LOCKPORT – A plea bargain may be in the works for David L. Alfonso, a Lockport man charged with the attempted murder of his girlfriend’s 7-year-old daughter on New Year’s Eve.

After a 40-minute closed-door conference between the attorneys and Niagara County Judge Sara Sheldon Farkas, the case was adjourned until July 8.

Court-appointed defense attorney David C. Douglas said prosecutors have made a “contingent plea offer,” which he wouldn’t disclose, but first, information is needed from more witnesses.

Alfonso, 28, allegedly had choked the girl into unconsciousness before her mother stabbed Alfonso with a knife, causing him to flee. Police used a Taser electronic stun gun to subdue him. The mother was not charged.

Lockport boy struck by car while riding bike

LOCKPORT – A 14-year-old boy was taken by Mercy Flight to Women and Children’s Hospital, Buffalo, with leg and head injuries after he was struck by a vehicle while riding his bicycle along Robinson Road in the Town of Lockport about 4:45 p.m. Monday, the Niagara County Sheriff’s Office reports.

Deputies said the boy was riding west on the south shoulder of the road when he pulled into the westbound lane of the highway into traffic. Officers said his injuries did not appear to be life threatening. An infant in the vehicle was taken to Women and Children’s Hospital as a precaution.

District settles Wilson baseball bullying case

LOCKPORT – More than five years after varsity players were accused of bullying younger players on the Wilson High School baseball team, the lawsuit arising from that incident went to court Monday and was settled after half a day.

After opening statements to the jury and partial testimony by one of the three plaintiffs, the school’s attorneys made a deal instead of cross-examining the witness.

State Supreme Court Justice Richard C. Kloch Sr. ordered the terms of the settlement sealed and directed attorneys not to speak of it.

“This settlement is made with absolutely no admission of liability by the school district,” said David Adams of Hurwitz & Fine, one of the school’s attorneys. He declined to comment when a reporter asked him why the district settled.

In announcing the settlement, Kloch criticized the team’s coaches, William M. Atlas and Thomas J. Baia, who had been accused by the plaintiffs’ attorneys of not preventing the beating of junior varsity players on the team bus in April 2008.

James W. Grable of Connors & Vilardo, representing two JV players who said they were beaten, told the jury that Wilson had an anti-bullying policy but that the coaches allegedly didn’t know of it.

“In my opinion here, I believe the coaches here let down their players, and these young men lost their high school years,” Kloch said.

Mike Paul, a former spokesman for the coaches, called The Buffalo News and denounced Kloch.

“When an average attorney or a judge is involved in a sealed settlement, judges keep their mouths shut. For him to have said anything is unethical,” said Paul. “That clearly shows me this is a man who has an ego and wants his opinion known.”

One plaintiff, now 20, broke down on the witness stand, sobbing that the ostracism he received when he was blamed for blowing the whistle on three teammates made him want to kill himself.

“There were thoughts of suicide,” said the witness, a ninth-grader at the time.

That plaintiff, represented by attorney Christopher O’Brien, was not assaulted himself, but he said the only one of the alleged perpetrators who pleaded guilty told him “I was next in line.”

“If an adult had been sitting between them, this interchange could have been avoided,” another of the school’s attorneys, Andrea Schillaci, told the jury. But she contended Atlas put the policy into action by texting a report to the school athletic director the night of the second incident on the team bus.

The News is not using the names of the students involved in the 2008 incident. Three players were arrested and originally charged by State Police with sexually abusing the JV players. Atlas and Baia also were charged with endangering the welfare of a child for allegedly failing to prevent the attacks.

The Niagara County District Attorney’s Office eventually dropped the sexual abuse felonies and reduced the charges to misdemeanors of forcible touching and hazing.

In 2009, one player, now 23, pleaded guilty to child endangerment and was granted youthful offender status. The other two were tried behind closed doors by Wilson Town Justice George R. Berger and acquitted. The prosecution then dropped the charges against Baia and Atlas.

The following week, Connors & Vilardo filed civil suits against the school district, not the coaches, on behalf of two victims, who were in eighth grade in 2008. The parents of O’Brien’s client, who sought to protect the other two JV players, already had sued.

O’Brien’s client testified that his parents took him to a psychologist. “He saved my life. He saved my family’s life,” the young man sobbed.

But in fall 2008, he entered a 10th-grade math class and found one of the alleged perpetrators had been readmitted to school and seated next to him. “Horrible. I don’t know why they would do that,” the witness said. “There was no notification he was coming back to school.”

The parents of O’Brien’s client and the parents of the two victimized players removed their sons from Wilson High School. Two transferred to a Catholic high school in Buffalo, while the third family moved to Genesee County and placed the son in a public school. All have graduated.

Former East Amherst medical office administrator pleads guilty to embezzlement

Kathleen B. Pittman, 47, pleaded guilty today before State Supreme Court Justice M. William Boller to embezzling $20,742 from the Northtowns Orthopedics business at 8750 Transit road, East Amherst while she was administrator and billing secretary for the company from Jan. 4, 2006 until this past Nov. 19.

Senior Prosecutor Susan H. Sadinsky told The Buffalo News that Pittman of Bella Drive in North Tonawanda falsified patient billing records and kept for herself any patient co-pays made in cash during visits to the business. Sadinsky said Pittman, who is currently employed at two other Buffalo-area medical offices, admitted using the stolen funds for personal expenses.

Free on her own recognizance without bail pending her Sept. 9 sentencing, Pittman pleaded guilty to the highest criminal charge she had faced had she been convicted at a trial, Sadinsky said. She faces a maximum prison term of four years, the prosecutor said. Neither Pittman or her attorney could be reached to comment.

Gowanda woman charged with aggravated DWI under Leandra’s Law

HANOVER – A 47-year-old Gowanda woman was arrested on drunken driving charges and aggravated drunken driving charges for having an eight-year-old child in her care when stopped at Routes 5 and 20 by Chautauqua County sheriff’s deputies about 6:45 p.m. Sunday.

Patricia A. Lipowicz of Route 62, Gowanda, was remanded to the Chautauqua County jail after her arraignment on the driving while intoxicated and Leandra’s Law charges and traffic infractions of failing to keep right, unsafe lane charges, aggravated unlicensed operation of a motor vehicle and consumption of alcohol in a motor vehicle.

She was reportedly observed driving to the left of the center of Alleghany road and then driving erratically at the intersection where she was stopped.
