Teen pulled from canal near Ellicott Creek Island dies

The rescuers tried their best Monday night to save a teen they found floating on the Erie Canal at Ellicott Creek Island.

But the young man they pulled from the water died Tuesday night at Erie County Medical Center.

Brian P. Murphy was out on a leisurely kayaking trip Monday evening with his two sons and two of friends, looking for turtles among the logs near shore at Ellicott Creek Island. At about the same time, a 28-year-old Lockport man was riding his bicycle on the nearby bike path off Old Niagara Falls Boulevard.

Little did these two men know that they would meet that night, because of another bicyclist riding on the same path, 18-year-old Matthew Hovagimian.

All apparently were enjoying the gorgeous late-spring night, until Hovagimian fell off his bike and into the water.

Both Murphy and the Lockport man, who didn’t want his name used, know CPR and began the emergency measures to revive Hovagimian. Emergency personnel from the Ellicott Creek Fire Company and Twin City Ambulance responded.

Hovagimian died about 8 p.m. Tuesday in Erie County Medical Center.

“The two of us gave this kid a second chance,” Murphy, a 50-year-old engineer from North Tonawanda, said Tuesday, before word of the teen’s death reached him.

Murphy marveled at the series of unconnected events that brought all three men to the same location, two of them to rescue the third one.

“I’m still kind of freaked out by the whole thing,” he said. “My religious belief is that all those random events had to line up for us to find him.”

Murphy agreed to tell his story, to emphasize two major points: the need to learn, or brush up, on CPR skills and the willingness to help in a life-saving situation.

“We’re not heroes, but there is a component of human nature to help,” he added.

The incident began for Murphy and his fellow kayakers just before 7:45 p.m. Monday.

His son, Shane, 18, on the trip along with brother Bryce, 13, and two of Bryce’s friends, spotted a bicycle at the edge of the water. Brian Murphy was in the lead kayak.

“I looked at the bike, I saw a sneaker, and then I saw a leg,” he recalled. “The gentleman was face-down in the water, between a log and the bank. But his face was submerged.

“I started yelling at him, ‘Are you O.K.?’ Then I took my paddle and nudged his back. There was no response at all.”

Murphy had no idea whether the young man was alive.

Since no one in his crew had brought a cellphone on the kayak trip, he started yelling for help and pleading with anyone to call 911.

That’s when the Lockport man heard the cries, got off his bike and went down the bank to help.

The two rescuers then had to get the unconscious Hovagimian up a steep embankment. One grabbed him under the arms, the other under his hips. Then they carried him up the bank, about 2 feet at a time.

“It was muddy and slippery,” Murphy remembered. “I think adrenaline allowed us to haul this kid up from the water.”

The men rolled Hovagimian onto his side, cleared his airway, started CPR compressions and called 911 on the Lockport man’s cellphone.

The 28-year-old Lockport man even employed one of his CPR instructor’s lessons – timing his chest compressions to the beat of the disco song, “Stayin’ Alive.”

As luck would have it, Ellicott Creek volunteer firefighters were involved in a nearby training session and reached the scene quickly, along with the ambulance crew, managing to revive the young man. Hovagimian had no identification on him at the time of the accident and was initially considered a John Doe. He was taken to DeGraff Memorial Hospital in North Tonawanda and then transferred to ECMC.

Following a preliminary investigation, Amherst police believe the young man may have suffered from some kind of medical condition that led to his falling off his mountain bike on a bike path near the creek.

Authorities don’t know how long he was in the water.

“Judging by his condition, I would guess it wasn’t more than a few minutes,” Amherst Police Capt. Enzio G. Villalta said. “He couldn’t have been in the water for an extended period of time, because they were able to revive him.”

Amherst police are asking anyone with information about the mishap to call them at 689-1311.

Meanwhile, Murphy was hoping that the rescue story might have an effect on others.

“Do your CPR training and be willing to stop and help out,” he advised.

Deputies arrest two women preparing to inject heroin on Squaw Island

Two young women from Evans were taken into custody along Buffalo’s waterfront Tuesday afternoon as they prepared to inject themselves with heroin, Erie County sheriff’s deputies reported.

Deputies on marine patrol were in the area of Squaw Island at about 1:45 p.m. Tuesday when they saw the two mixing a preparation of heroin to be injected with a hypodermic needle, the sheriff’s department reported. The women were taken into custody without incident before injecting the drug, deputies said.

Amanda C. Thiel, 22, and Brittney M. Hammond, 21, were charged with misdemeanor counts of possession of a controlled substance and of a hypodermic instrument, as well as loitering. Deputies said Hammond also was charged with a violation count of unlawful possession of marijuana.

Hammond was taken to the county holding center in lieu of $250 bail; Thiel was issued tickets to appear July 9 in Buffalo City Court.

Killer of bus driver sentenced to 25 years to life in prison

After unsuccessfully trying to persuade a judge to set aside his second-degree murder conviction, Joshua J. Mitchell was sentenced today to 25 years to life in prison for fatally shooting popular Metro Bus driver Brian G. Chapman Jr.

Chapman, 37, was on his porch last year waiting for a ride to work before sunrise when he was killed.

Mitchell, 26, expressed no remorse, claiming he was innocent and also the victim of “ineffective” legal representation in the trial against him for the Guilford Street shooting of Feb. 1, 2012.

Mitchell told authorities he was in the neighborhood looking to buy marijuana.

A Buffalo police officer was on patrol in an unmarked patrol car on Guilford Street at the time of the shooting and heard the gunshots. The officer pursued and stopped the car carrying Mitchell and arrested him.

Erie County Judge Thomas P. Franczyk denied Mitchell’s request for a new trial, telling Mitchell he could take up his concerns with the Appellate Division of State Supreme Court.

“He was well loved and making a life for himself. All he was doing was standing on the porch waiting to go to work. You, on the other hand, were trolling the streets before dawn,” Franczyk said.

“Since 2003, you have been arrested for criminal possession of a controlled substance, disorderly conduct, false impersonation, attempted assault and criminal possession of stolen property. In 10th grade you dropped out of high school and here we are,” Franczyk said.

The judge also sentenced Mitchell to 15 years for criminal possession of a .38 caliber handgun and five years of supervised release. The sentences will run concurrently.

Vicki Chapman, the bus driver’s mother, told Mitchell during her statement to the court that he senselessly took a life and that he should reflect on his actions.

Mitchell’s relatives angrily left the courtroom, saying there were others in the vehicle police stopped when arresting Mitchell and that he was innocent.

An Erie County jury delilberated for about three hours before returning a guilty verdict on March 14.

During the trial, prosecutor Gary W. Hackbush, who prosecuted Mitchell along with Assistant Erie County District Attorney John P. Gerken Jr., told jurors Mitchell was the only one to get out of the car and scoffed at Mitchell’s “phantom gunman” theory.

Drug charges dismissed for UB students arrested last fall in University Heights

Drug charges against several University at Buffalo students arrested last fall in University Heights have been dismissed in Buffalo City Court, authorities said Wednesday.

The young men were among seven individuals arrested in a West Northrup Place home after police seized $64,000 in cash, 9 pounds of marijuana and other drugs there.

Two non-students, Joseph Mruk, 26, of West Seneca, and Anthony Argiros, 22, of Hancock, pleaded guilty to criminal possession of marijuana and were recently sentenced to probation by Judge James A. W. McLeod.

The charges against Andrew Pawluk, Marc Harding, Ruben Abramov, Jonathan Ho and Brennon Hall were dropped, officials said.

Robber flees with cash from First Niagara branch bank in Niagara Falls

NIAGARA FALLS – Niagara Falls detectives are searching for a man who robbed the First Niagara Bank branch at 805 Main St. just before 1 p.m. today.

The bandit, who handed a threatening note to a teller but displayed no gun, fled on foot with a large amount of cash, northbound on Main Street.

He was described as a black man, 5 foot 10 to 6 feet tall, wearing a white, long-sleeve button-down shirt, khaki pants, mirrored sunglasses, white socks, brown sandals and a tan cap.

Anyone with information about the robbery is asked to call the Niagara Falls Police Department’s Criminal Investigation Bureau at 286-4553.

NIAGARA FALLS, Ont. – 31-year-old Niagara Falls man was seriously injured at 7 a.m. Wednesday when hit by an SUV while cutting grass on Beaverdams Road. just west of Kalar Road.

The victim was being treated in Erie County Medical Center, Buffalo, with life-threatening injuries. Niagara Regional Police said the driver of the SUV, a 41-year-old Niagara Falls woman, lost control and the SUV slammed into the man, who was cutting grass along the shoulder of the road. The driver was treated for minor injuries in Greater Niagara General Hospital and released.

The crash remains under investigation. Witnesses are asked to contact investigators at (905) 688-4111, ext. 5500.

All three were taken to Eruie County Medical Center. Buffalo Police said one car was heading north on Broadway at the time of the collision at Ash, Police said sunlight glare may have played a role in the crash. Further information was unavailable.

High street man charged with hitting friend with a brick

A High Street man arrested early Wednesday on third-degree assault and harassment charges is accused of throwing a brick at a friend during an argument.

Police said Mark James, 44, hit the victim on the right wrist. The victim went to Buffalo General medical Center for treatment, police said.

The patient, idcentified as Rashaad R. Welch, 22, of Niagara Street, was charged Monday with two counts of second-degree assault and third-degree menacing.

The attack occurred last Thursday, said police, who added that victim was grabbed by the throat and punched n the face, then dragged into a room, where she was punched and kicked.

The female nurse was treated in the hospital’s emergency room for injuries to the elbow, wrist and knee, police said.

A Bristol Street man is charged with felony arson for starting a fire inside a house in the 400 block of Bristol about 4:30 a.m. Wednesday, police said.

Dominique Bailey, 28, also was charged with reckless endangerment and endangering the welfare of a young child that firefirefighters found in the house after the fire was extinguished.

West Seneca man facing prison in plea deal on sex attack

LOCKPORT –A West Seneca man charged with sexually attacking a 12-year-old girl in North Tonawanda last year accepted a plea deal Wednesday in Niagara County Court.

Justin C. Wheeler, 21, of Westminster Road, admitted to a reduced charge of attempted first-degree rape in connection with the Nov. 18 attack. Prosecutors said the sex was not forcible and the rape charge stemmed from the girl’s age.

County Judge Sara Sheldon Farkas said she will sentence Wheeler, who had no prior criminal record, to between five and 10 years in prison. sentencing is set for Sept. 10. As

Falls sex offender pleads guilty to three felony charges

LOCKPORT – A Level 3 sex offender is headed back to prison after admitting Wednesday that he had sex with a 15-year-old girl last year.

Isaac L. McDonald, 29, of 24th Street, Niagara Falls, pleaded guilty to third-degree rape, failure to register as a sex offender and disseminating indecent material to a minor as a sexually motivated felony.

McDonald could face up to 18 years in prison when Niagara County Judge Sara Sheldon Farkas sentences him Sept. 11. He had served more than five years after pleading guilty to two counts of second-degree rape in 2003, for having sex with 14- and 15-year-old girls.

McDonald was accused of having sex with the 15-year-old seven times from March 24 through May 10, 2012 – one one occasion, forcibly.

McDonald has been in Niagara County Jail, in lieu of $250,000 bail, for the past year.

Buffalo man facing time in federal prison for heroin conspiracy

A Buffalo man has been sentenced to 70 months in federal prison on heroin conspiracy charges by U.S. District Judge Richard J. Arcara, U.S. Attorney William J. Hochul Jr. said Wednesday.

Antonio Almonte, 57, was convicted of conspiring to possess and distribute more than a kilogram of heroin. He was arrested after the Ohio State Highway Patrol stopped a truck and trailer in March 2012 and found 2.4 kilograms of heroin. Prosecutors said it was being shipped from Chicago to the Buffalo area.

A co-defendant, Luis Vazquez, 40, of Buffalo, was sentenced last month by Judge Arcara to 51 months in prison on the same charges.

A Hudson Street man charged Tuesday with second-degree burglary is accused of breaking into a Krettner Street apartment and threatening a woman with a knife.

The suspect was identified as Angelo Balisteieri, 33. Police said bthey seized the knife as evidence.

Two men were arrested on drug and hypodermic instrument charges in the McDonald’s Restaurant at 390 Niagara St. about 7:40 p.m. Tuesday, Buffalo police said.

Joseph Spicola, 22, of Irving and Siles Preishel, 19, of Gowanda, were charged each with criminal possession of a controlled substance and criminal possession of a hypodermic instrument.

Police said they found several hypodermic needles with heroin residue. Spicola also was charged with tampering with physical evidence, for allegedly trying to hide the needles in a bathroom waste basket.

Poloncarz startled from sleep as burglar climbs into home, flees with baseball bat

Erie County Executive Mark C. Poloncarz had a scare Monday when a burglar broke into his Delaware Avenue home while he was sleeping.

Poloncarz said he was awakened at about 5:30 a.m. by the noise of the burglar pushing out a screen and climbing through an open downstairs window. He said he immediately called police and yelled at the burglar, who fled with a baseball bat belonging to Poloncarz. The county executive said he ventured downstairs but never saw the thief, adding that the intruder tried to access the house through two other windows.

Avello A. Pena, 22, of Buffalo, was arrested a short time later by police responding to the 911 call. Officers said they noticed Pena running with a bat.

When they stopped him, Pena said he was going to meet friends at Front Park. But police doubted his explanation for being out so early with a baseball bat and charged him with burglary.

Poloncarz, who testified Wednesday before a grand jury, said police told him that Pena had been drinking. The window Pena allegedly entered is 8 feet off the ground, and a recycling tote was used to reach it, Poloncarz said.

Ransomville home in deplorable shape officially condemned

RANSOMVILLE – Niagara County sheriff’s deputies called to check on the well-being of a Harris Avenue man Wednesday found his home in deplorable conditions and officially condemned it.

The man, who had bot been seen for nearly a week by neighbors coworkers, was not at home and later determined to be a patient in a Buffalo hospital.

Deputies entered the bhome, in the 3500 block of Harris, through an unsecured door and discovered garbage, rotting food, clutter and junk throughout the house – with only a narrow path to navigate the house and large buckets beneath hole sin the ceiling to catch rain.

Town of Wilson Building Inspector Lawrence Banks inspected the house and condemned it.
