A 37-year-old Lackawanna man is in custody at the Erie County Holding Center after being arrested on a second-degree assault charge stemming from a fight last August that left a man with a brain injury and limited use of his arms and legs, Buffalo police announced Wednesday.
Joseph J. Driscoll, of Abbott Road, was arrested by Officers James Scherer and Daniel Kurdziel Wednesday afternoon on Duerstein Street.
He is accused of punching the victim in the mouth during a fight on outside stair at a building in the 2000 block of Seneca Street about 12:05 a.m. last Aug. 17. The force of the punch allegedly knocked the victim off the stairs and he fell and was knocked unconscious when his head struck the sidewalk.
The victim was hospitalized at Erie County Medical Center for four months for treatment of a traumatic brain injury and was transferred to the Erie County Home for rehabilitation, according to a police report.
