A neighbor of a man killed in his Elmwood Avenue apartment the day after Christmas was arraigned today on an indictment charging him with second-degree murder.

Pedro Rivera, 37, of the Stuyvesant Apartments on Elmwood near Summer Street, pleaded not guilty before Erie County Judge Thomas P. Franczyk, who remanded him to the Erie County Holding Center where he has been held since his arrest last month.

He is accused of fatally stabbing Youself Kabalan, 68, in the victim’s apartment on Dec. 26. The victim’s body was found there three days later.

He faces a maximum prison term of 25 years to life if convicted, according to Erie County District Attorney Frank A. Sedita III.
