A Hamburg man convicted of seven burglaries and six other felonies in the last 2½ years has been convicted in three more break-ins.
Justin Middagh, 30, of Seaford Terrace, pleaded guilty last week to three counts of third-degree burglary for break-ins last summer in Hamburg, according to Erie County Assistant District Attorney John P. Gerken Jr.
Middagh admitted throwing a brick through a glass door at Maxi’s Pizza at 4097 Lake Shore Road on July 4 and stealing surveillance equipment. He also admitted throwing a rock through a front window at Brooks Pharmacy at 4481 Lake Shore Road that same night with the intention of stealing drugs, but he fled when an alarm sounded.
On Aug. 7 he succeeded in stealing drugs from Brooks Pharmacy after throwing another object through the front window.
At the time of the break-ins, Middagh had been on parole for four months after serving six months in a shock incarceration program following his July 12, 2012, conviction on four counts of third-degree burglary involving break-ins at Brooks Pharmacy and three other Lake Shore Road businesses over a two-month period, according to District Attorney Frank A. Sedita III. Middagh had been sentenced to two to seven years in prison for those burglaries but got out early after completing the shock incarceration program.
His other felony convictions include driving while intoxicated, criminal mischief and drug possession.
Middagh faces up to 21 years in prison when he is sentenced March 5 by State Supreme Court Justice John L. Michalski.
But Sedita said the court has committed to sentencing Middagh to a program that would require him to remain at a drug treatment facility for 90 days, before being released on parole.
