LOCKPORT – A Niagara Falls man pleaded not guilty Monday in Niagara County Court to an indictment accusing him of trying to break into an apartment on Lincoln Place in that city about 1 a.m. Oct. 7.
Kyle D. Sullivan, 24, of Linwood Avenue, is charged with attempted second-degree burglary and fourth-degree criminal mischief. The same charges are lodged against co-defendant Robert L. Shimmel, 32, of South Avenue in the Falls, who has yet to be arraigned.
Deputy District Attorney Doreen M. Hoffmann said the men allegedly damaged the apartment door but failed to enter before a neighbor called police, who caught them at the scene.
