LOCKPORT – A Niagara Falls man who was to have gone to trial Wednesday on a felony assault charge accepted a plea offer, and Niagara County Judge Sara Sheldon Farkas said she is likely to give him a conditional discharge when he returns to court Nov. 8.
Robert V. Abrams Jr., 48, of Ontario Avenue, admitted to third-degree assault, a misdemeanor. He had been charged with a felony after swinging an object and gashing the head of his daughter’s boyfriend, Gabriel B. Felts, 29, on July 16, 2012. The plea canceled a scheduled nonjury trial.
Defense attorney Robert Viola said Abrams confronted Felts after the latter allegedly poured a glass of water over the head of Abrams’ daughter. Farkas said all sides, including the prosecution, agreed that Abrams’ attack on Felts was completely out of character.
