LOCKPORT – The brother of a man killed while walking on Hyde Park Boulevard in Niagara Falls two years ago filed a wrongful death suit against the driver this week in State Supreme Court.
The plaintiff is Victor Fetter of 67th Street, brother and executor of the late Joseph W. Fetter Jr. The latter was 53 when he died Aug. 27, 2011, in Erie County Medical Center. That was eight days after Fetter, a Cedar Avenue resident, allegedly was struck by a vehicle driven by Eric M. Bajor, now 25, of Swann Road, Lewiston.
City and county court officials had no record of Bajor ever being prosecuted in the case.
Bajor’s father, Mark E. Bajor, also was named as a defendant in the lawsuit because he allegedly owned the vehicle that struck Fetter.
The suit, filed by attorney Michael J. Skoney of the Niagara Falls firm of Viola, Cummings and Lindsay, does not name the damage amount being sought.
