A Town of Brant man faces felony drunken driving and other charges following rollover crash Tuesday in North Collins.
James R. Nelms, 29, of Orchard Meadows Drive. was found by Erie County sheriff’s deputies shortly after 9 a.m., near the overturned vehicle he was driving. Nelms, who was unharmed in the crash, was the only occupant of the vehicle, deputies said. Deputies later determined that Nelms was intoxicated and also had a revoked driver’s license because of a prior driving while intoxicated conviction. They also learned that Nelms had taken the vehicle, which belongs to his grandmother, without her permission, according to sheriff’s officials.
Nelms refused to take a chemical breath test. He was charged with felony DWI, unauthorized use of a motor vehicle, circumventing an interlock device, and failure to keep right.
Nelms was taken to the Erie County Holding Center and held pending his arraignment in North Collins Town Court.
