A 40-year-old Sardinia man, with two drunken-driving convictions, was charged again with DWI after he was spotted driving an all-terrain vehicle on a public road, according to Erie County sheriff’s deputies.
A deputy on patrol on Savage Road in the town at about 8:30 p.m. Thursday saw an ATV being driven on the road. When the deputy attempted to stop the vehicle to talk with its driver, the ATV driver took off, deputies said.
John Murphy subsequently was located with the help of additional deputies and state police. Murphy refused to submit to a chemical breath test, and he was charged with felony counts of driving while intoxicated and aggravated unlicensed operation, as well as multiple vehicle and traffic law violations.
Deputies said that Murphy had DWI convictions in November and December 2010. He was released Thursday night to a third party, pending a future appearance in Sardinia Town Court.
