Gowanda woman faces DWI, other charges, after traffic stop

Getting pulled over for speeding and driving on the shoulder of a road on the Cattaraugus Indian Reservation early today was only the beginning of trouble for a 21-year-old Gowanda woman, according to Erie County sheriff’s deputies.

Deputy Matt Krypel made the traffic stop about 3 a.m. on Southwestern Boulevard, where Kelly C. Mallaber was charged with driving while intoxicated after failing field sobriety tests. A breath test, performed at the North Collins substation, revealed a blood-alcohol content of .20 percent, deputies said.

The level of intoxication led to a charge of aggravated DWI, deputies said. Her driver’s license was suspended because of failure to answer a summons, leading to a charge of aggravated unlicensed operation.

Mallaber also was ticketed for speeding, driving on the shoulder of the road, having an open container of alcohol in a vehicle and obstructed view. Her vehicle was towed from the scene of her arrest, to be held for 12 hours, and she was released in her mother’s custody, pending an appearance in Brant Town Court.
